Vietnam: 07 economic regions for formulation of land price brackets applicable from December 19, 2019

Recently, the Government of Vietnam issued Decree No. 96/2019/NĐ-CP on land price brackets.

Specifically, according to Article 4 of Decree No. 96/2019/NĐ-CP of Vietnam’s Government, land price brackets for each region specified in Article 113 of the Land Law include:

1. The Northern Midlands and Mountains include the following provinces: Dien Bien, Lai Chau, Son La, Hoa Binh, Ha Giang, Tuyen Quang, Cao Bang, Bac Kan, Lao Cai, Yen Bai, Phu Tho, Lang Son, Thai Nguyen, Bac Giang and Quang Ninh.

2. The Red River Delta region includes provinces and central-affiliated cities: Vinh Phuc, Bac Ninh, Hanoi, Hai Phong, Hai Duong, Hung Yen, Ha Nam, Nam Dinh, Thai Binh and Ninh Binh.

3. The North Central region includes the provinces: Thanh Hoa, Nghe An, Ha Tinh, Quang Binh, Quang Tri and Thua Thien Hue.

4. The South Central Coast region includes provinces and central-affiliated cities: Da Nang, Quang Nam, Quang Ngai, Binh Dinh, Phu Yen, Khanh Hoa, Ninh Thuan and Binh Thuan.

5. The Central Highlands region includes the provinces: Kon Tum, Gia Lai, Dak Nong, Dak Lak and Lam Dong.

6. The Southeast region includes provinces and central-affiliated cities: Dong Nai, Binh Duong, Binh Phuoc, Ba Ria - Vung Tau, Tay Ninh and Ho Chi Minh City.

7. The Mekong Delta region includes provinces and central-affiliated cities: Long An, Tien Giang, Ben Tre, Dong Thap, Vinh Long, Tra Vinh, Can Tho, Hau Giang, Soc Trang, An Giang, Kien Giang, Bac Lieu and Ca Mau.

Decree No. 96/2019/NĐ-CP guides the application of land price brackets as follows:

- The land price bracket is used as a basis for the People's Committee of the province and central-affiliated city (hereinafter referred to as the Provincial People's Committee) to develop and adjust the land price list in the locality.

- The Provincial People's Committee, based on the realities of the locality, is entitled to determine the maximum land price in the land price table, the adjusted land price not more than 20% higher than the maximum land price of the same type of land in the land price bracket.

- Provincial People's Committees, based on local reality, may set the maximum price in the land price list and adjusted land price list according to the provisions of Point a Clause 3 Article 11 of Decree No. 44/2014/NĐ-CP dated May 15, 2014 of Vietnam’s Government on land prices compared to the maximum price of the same type of land in the land price frame after adjustment.
