Vietnam: 06 contents of specialized inspection in the field of enterprises and business registration

Recently, the Government of Vietnam issued Decree No. 216/2013/ND-CP on the organization and activities of inspection in the Planning and Investment sector.

According to Article 18 of Decree No. 216/2013/ND-CP of Vietnam’s Government, 06 contents of specialized inspection in the field of enterprises and business registration are as follows:

1. Inspection of compliance with regulations on establishment and business registration of various types of enterprises, dependent units of enterprises, and individual businesses.

2. Inspection of compliance with the contents stated in the enterprise registration certificate for different types of enterprises and the business registration certificate for individual businesses.

3. Inspection of compliance with regulations on organizational structure, management, and operation of different types of enterprises.

4. Inspection of compliance with regulations on division, separation, merger, consolidation, conversion, and dissolution of different types of enterprises.

5. Inspection of compliance with regulations on providing and disclosing business registration information.

6. Inspection of compliance with other regulations as stipulated by the law on enterprises and business registration.

Concurrently, Decree No. 216/2013/ND-CP also specifies the content of specialized inspection in the field of cooperatives and cooperative unions as follows:

- Inspection of compliance with regulations on capital contribution, establishment, registration, and amendment of registration content of cooperatives and cooperative unions.

- Inspection of compliance with regulations on the conditions to become members of cooperatives and cooperative unions.

- Inspection of compliance with regulations on division, separation, merger, consolidation, and dissolution of cooperatives and cooperative unions.

- Inspection of compliance with other regulations as stipulated by the law on cooperatives and cooperative unions.
