Vietnam: 05 principles of control of administrative procedures in military and national defense

Circular No. 92/2015/TT-BQP regulating and guiding the activities of administrative procedure control within the scope of the state management functions of the Ministry of Defense of Vietnam was issued on August 11, 2015.

According to Circular No. 92/2015/TT-BQP of the Ministry of Defense of Vietnam, the control of administrative procedures shall be carried out according to Article 4 of Decree No. 63/2010/ND-CP on controlling administrative procedures and the following principles:

1. Ensure the unified direction of the Minister of Defense.

2. Ensure regular and close coordination among agencies, units, and individuals involved in administrative procedure control activities.

3. Ensure transparency and openness in administrative procedure control activities.

4. Facilitate agencies, units, and individuals in participating in administrative procedure control within the scope of state management of the Ministry of Defense.

5. Strictly comply with the provisions of the law regarding the sequence, procedures, deadlines, and public disclosure of administrative procedures.

Concurrently, Circular No. 92/2015/TT-BQP also specifies the administrative procedure control activities in the military, national defense, and other areas under the state management authority of the Minister of Defense (hereinafter referred to as within the scope of state management functions of the Ministry of Defense), including:

- Assessing the impact and providing opinions on administrative procedures;

- Publicizing administrative procedures;

- Publicly disclosing and posting administrative procedures;

- Reviewing and evaluating administrative procedures;

- Monitoring the situation and results of administrative procedure control activities;

- Receiving and handling feedback and suggestions on administrative regulations;

- Responsibilities for administrative procedure control and reporting mechanisms for administrative procedure control work.
