Recently, the Ministry of Justice of Vietnam issued Circular 05/2020/TT-BTP to provide guidance on Decree 08/2020/ND-CP regarding the organization and operation of bailiff.
Vietnam: 05 documents proving exemption from Bailiff training (Illustrative image)
According to Circular 05/2020/TT-BTP, documents proving exemption from bailiff training in Vietnam as stipulated in Clause 2, Article 7 of Decree 08/2020/ND-CP include:
1. Decision of appointment as judges, prosecutors, executors, investigators; Judge's ID, Prosecutor's ID, Executor's card, Investigator's certificate, accompanied by documents proving a minimum of 05 years of experience as a judge, prosecutor, executor, or investigator;
2. Lawyer practice certificate, Decision of appointment or reappointment as notaries, Lawyer's card, Notary's card accompanied by documents proving a minimum of 05 years of practice as a lawyer or notary;
3. Decision of appointment for the titles of Professor, Associate Professor in Law; and Doctorate in Law, in cases where the Doctoral degree in Law is issued by a foreign educational institution, the degree must be recognized according to the regulations of the Ministry of Education and Training of Vietnam;
4. Decision of appointment as principal assessors, senior assessors in the judiciary, principal examiners, senior examiners in procuracy, and principal assessors, senior assessors in the enforcement of civil judgments; principal inspectors, senior specialists, senior researchers, senior lecturers in the field of law;
5. Other documents proving exemption from bailiff training according to legal regulations.
