This is an important content specified in Decree No. 31/2014/NĐ-CP of Vietnam’s Government detailing a number of articles and measures to implement the Residence Law.
According to Vietnam’s regulations, a citizen's place of residence is a permanent place of residence or a temporary place of residence. Each citizen can only register for permanent residence in one legal residence and a place of regular residence. In particular, legal accommodation can be owned and used by citizens or rented, lent, or rented by agencies, organizations, and individuals according to the provisions of law. For legal accommodation rented, borrowed or stayed by individuals or organizations in central-affiliated cities, it must ensure the average area conditions according to regulations of the City People's Council. Legal accommodation includes:
a) Housing;
b) Ships, boats, and other vehicles for the purpose of living and serving daily activities of households and individuals;
c) Other houses that are not included in Points a and b of this Clause but are used for residential purposes and to serve daily activities of households and individuals.
However, according to Clause 4 Article 5 of Decree No. 31/2014/NĐ-CP of Vietnam’s Government, citizens shall not register permanent residence when citizens move to a new residence in one of the following cases:
- Accommodation located in prohibited locations, prohibited construction areas or encroaching on boundary markers protecting classified technical infrastructure works, historical and cultural relics;
- Accommodation where the entire housing area is located on illegally encroached land;
- The accommodation has a compensation, support and resettlement plan from the competent state agency; accommodation is a house in which part or the entire area of the house is subject to disputes or complaints related to ownership and use but has not been resolved according to the provisions of law (except in cases where related people are grandparents, grandparents, father, mother, wife, husband, or children moving to live together);
- Accommodation is distrained, confiscated to execute a judgment, or requisitioned according to the decision of a competent state agency;
- Accommodation is a house that has had a demolition decision from a competent state agency.
