Vietnam: 04 responsibilities in the assurance of equal participation of legally aided persons

This is noteworthy content in Circular 11/2014/TT-BTP on the assurance of gender equality in legal aid, issued by the Ministry of Justice of Vietnam on April 17, 2014.

Under Circular 11/2014/TT-BTP, when providing legal aid, the legal aid-providing organizations and the legal aid-providing persons in Vietnam are responsible for:

  1. Closely coordinating with information agencies, media, political-social organizations, political organizations, socio-professional organizations, socio-professional organizations, and local government to communicate and disseminate the law on gender equality and general information related to legal aid cases as stipulated in Clause 1, Article 12 of this Circular;
  2. Facilitating legally aided persons in accessing and exercising their rights and obligations as prescribed by law without gender discrimination;
  3. Not exerting pressure or exploiting the gender vulnerabilities of the legally aided persons to force them to make immediate decisions regarding the resolution of cases;
  4. Informing legally aided persons about their lawful rights, interests, and rights to protection, fair treatment, and other rights and obligations when they request legal aid.

At the same time, legal aid-providing organizations in Vietnam must choose the time and method of providing legal aid suitable to the gender, psychology, and customs of the locality to ensure that both men and women have equal access to legal aid activities, and can participate in and exercise their rights and obligations in accordance with the law.
