Vietnam: 04 requirements for operation regulations of project management boards

This content is specified in Circular No. 16/2016/TT-BXD of the Ministry of Construction of Vietnam providing guidance on application of a number of articles of the Decree No.59/2015/ND-CP of Vietnam’s Government on construction project management.

According to Circular No. 16/2016/TT-BXD of the Ministry of Construction of Vietnam, Directors of project management boards (PMBs) shall submit the PMB operation regulation to the PMB founder to review for approval. The operation regulation shall satisfy the following criteria:

- The operation regulation shall specify functions, rights and responsibilities as the project investor; responsibilities for project management and scope of work in liaison with relevant agencies and within the PMB.

- The organizational structure and personnel shall be appropriate to the project quantity, sale and nature. The responsibilities as investor and project management responsibilities shall be separate.

- Rights, responsibilities and required qualifications of each position or title in the PMB shall be clearly defined.

- The PMB shall exercise financial autonomy and finance its own recurrent expenditures.
