Vietnam: 04 principles for coordinating the management of foreigners' entry and exit

Coordination mechanism between ministries, ministerial-level agencies, and People's Committees of provinces and central-affiliated cities in the management of entry, exit, transit, and residence of foreigners in Vietnam must comply with the following 04 principles listed in Article 3 of Decree No. 64/2015/NĐ-CP of Vietnam’s Government:

- Comply with the provisions of the Law on Entry, exit, transit, and residence of foreigners in Vietnam and relevant legal documents.

- Ensure proactive, regular, strict, timely, and create favorable conditions for foreigners to enter, exit, transit, and reside in Vietnam according to the provisions of law.

- Ensure centralized, unified, non-overlapping direction and administration, according to the principle that the Ministry of Public Security presides over state management of entry, exit, transit, and residence of foreigners in Vietnam; Ministries and ministerial-level agencies, based on their functions, tasks, powers and organizational structures, are responsible for coordination; People's Committees of provinces and central-affiliated cities (hereinafter referred to as Provincial People's Committees) shall be responsible for organizing uniform implementation locally according to the provisions of the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam and instructions of the Ministry of Public Security.

- Does not affect the functions, tasks and professional activities of relevant agencies.

Besides, Decree No. 64/2015/NĐ-CP also stipulates that there are 06 main forms of coordination as follows:

- Exchange opinions and provide written information at the request of the presiding agency and coordinating agency.

- Through regular and extraordinary interdisciplinary meetings.

- Through preliminary and summary conferences.

- Through inspection and examination of interdisciplinary working groups chaired by the Ministry of Public Security.

- Through coordination regulations between ministries and branches according to Government regulations.

- Other forms.
