Vietnam: 04 methods to evaluate bids for consulting service packages of bidders who are organizations

On August 24, 2020, the Government of Vietnam issued Decree 95/2020/ND-CP providing guidelines on bidding process in procurement under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership.

Decree 95/2020/ND-CP stipulates 04 methods to evaluate bids for consulting service packages of bidders who are organizations in the bidding process in procurement under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership as follows:

- The least-cost method applies to simple consulting service packages. The criteria for evaluating the bid are technical evaluation criteria. For bids that have passed the technical evaluation step, the bidding price after error correction and deviation adjustment, minus the discount value (if any) is considered. The bidder with the lowest price is ranked first;

- The fixed-price method applies to simple consulting service packages, where the implementation cost of the package is specifically and fixedly determined in the bidding documents. The criteria for evaluating the bid are technical evaluation criteria. For bids that have passed the technical evaluation step, with the bidding price after error correction and deviation adjustment, minus the discount value (if any) not exceeding the package implementation cost, the technical score is used to compare and rank. The bidder with the highest technical score is ranked first;

- The combined technique and price-based method applies to consulting service packages that emphasize both the quality and implementation cost of the package. The criteria for evaluating the bid are technical evaluation criteria and composite evaluation criteria. The composite evaluation criteria are built based on a combination of technical and price scores. When setting composite evaluation criteria, it must ensure the principle that the weighting of technical scores is from 70% to 80%, the price scores from 20% to 30% of the total composite score, and the weighting of technical scores plus the weighting of price scores equals 100%. The bidder with the highest composite score is ranked first;

- The technique-based method applies to consulting service packages with high and specific technical requirements. The criteria for evaluating the bid are technical evaluation criteria. The minimum score not lower than 80% of the total technical scores must be stipulated when setting technical evaluation criteria. The bidder with a bid that meets the minimum technical score requirement and has the highest technical score is ranked first and is invited to open the financial proposal dossier as the basis for contract negotiation.
