Vietnam: 04 criteria to assess the impact of military and national defense administrative procedures

This is a notable content specified in Circular No. 92/2015/TT-BQP regulating and guiding the activities of administrative procedure control within the scope of the state management functions, issued on August 11, 2015 by the Ministry of Defense of Vietnam.

According to Circular No. 92/2015/TT-BQP of the Ministry of Defense of Vietnam, the agency or unit responsible for drafting legislative documents containing regulations on administrative procedures (hereinafter referred to as the drafting agency or unit) is responsible for conducting an impact assessment of the administrative procedures based on the following criteria:

- The necessity of the administrative procedure;

- The rationality of the administrative procedure;

- The legality of the administrative procedure;

- The costs of complying with the administrative procedure.

The drafting agency or unit shall use the impact assessment forms of administrative procedures and the accompanying guidance for responses in Appendices I, II, and Appendix IV issued with Circular No. 07/2014/TT-BTP dated February 24, 2014 of the Ministry of Justice guiding the assessment of the impact of administrative procedures and the review and evaluation of administrative procedures (hereinafter referred to as Circular No. 07/2014/TT-BTP).

Besides, the Legal Department of the Ministry of Defense shall be responsible for providing guidance to the drafting agency or unit on filling out the impact assessment forms of administrative procedures and calculating the costs of complying with administrative procedures; inspecting whether the drafting agency or unit has conducted the impact assessment and cost calculation of complying with the administrative procedures as prescribed in the draft legislative documents under the authority of the Minister of Defense.

Note: In cases where administrative procedures are amended or supplemented, the drafting agency or unit shall conduct the assessment of the contents specified in Clause 1 of this Circular, and clearly explain the simplicity and advantages of the amended or supplemented administrative procedures.
