Vietnam: 03 cases of revocation of the Certificate issued for product type

According to Circular No. 25/2019/TT-BGTVT of the Ministry of Transport of Vietnam, from August 25, 2019, the Certificate issued for product type will be revoked if:

- The manufacturing facilities dissolve, go bankrupt as per law.

- The manufacturing facilities fabricate documents in the certificate for type approval registration;

- The manufacturing facilities fail to rectify their violations within 06 months from the date the Certificate is suspended as specified in Clause 1, Clause 2 Article 13 of Circular No. 25/2019/TT-BGTVT.

Note: If the enterprises wish to continue manufacture, assembly and import of product type whose Certificate is revoked, they must reappraise the design dossier and verify again as done with a whole new product.

Also according to Circular No. 25/2019/TT-BGTVT, the quality control agencies must request the manufacturing facilities to suspend the manufacturing processes of product types if:

- The manufacturing facilities: fail to maintain the product quality control as per law; fail to carry out the release inspection as per law; fail to ensure the conformance of the released products to the certificate for type approval registration and the verified representative samples of the product type; fail to issue the Release record as per law;

- Failure to recall technically defective products as specified in Chapter III of this Circular;

- The manufacturing facilities deliberately erase, punch or alter the numbers of the chassis or engine without reporting to the quality control agencies;
