Vietnam: 02 cases of application of environmental protection fees on full exploitation of minerals

This is an important content specified in Decree No. 164/2016/NĐ-CP of Vietnam’s Government on environmental protection fees on mineral extraction activities.

According to Decree No. 164/2016/NĐ-CP of Vietnam’s Government, the environmental protection fees on full exploitation of minerals shall be applied in the following cases:

- Exploiting remaining minerals at waste dumps of mines of which decisions on closure of doors are available;

- Entities that obtain business registration certificates and operate in lines of business other than mineral extraction acquiring minerals during their operation.

- Environmental protection fees on full exploitation of minerals shall not apply in other cases beyond 02 cases of application of environmental protection fees on full exploitation of minerals.

Also according to Decree No. 164/2016/NĐ-CP, the environmental protection fees on full exploitation of minerals shall be calculated in compliance with regulations in Article 5 hereof.

View provisions on declaration and payment of fees at Decree No. 164/2016/NĐ-CP of Vietnam’s Government, effective from January 01, 2017.
