Upcoming, the Retirement Age for Female Teachers Will Be 60, Male Teachers Will Be 62

To be specific, according to Article 169 of this Draft, there will be 02 options regarding retirement age regulations for workers, specifically:

- Option 1: Fix the age and delegate the Vietnamese Government to regulate the roadmap.

According to this option, workers who meet the conditions for the duration of social insurance contributions as prescribed by the law on social insurance will receive a pension upon reaching the retirement age.

The retirement age for workers in normal working conditions will be adjusted according to a roadmap until reaching 62 years old for men and 60 years old for women.

From January 1, 2021, based on the occupation, nature of the work, environment and working conditions, regions, labor market supply and demand, population aging trends, the Vietnamese Government will regulate the roadmap for adjusting the retirement age of workers.

Workers with reduced working capacity; those engaged in particularly heavy, harmful, dangerous occupations and jobs; those engaged in heavy, harmful, dangerous occupations and jobs; those working in areas with particularly difficult socio-economic conditions may retire at a lower age but not more than 05 years earlier than the prescribed retirement age at the time of retirement, unless otherwise provided by law.

Workers with high technical expertise and certain special cases may retire at a higher age but not more than 05 years later than the prescribed retirement age at the time of retirement.

- Option 2: The Vietnamese Government proposes technical adjustments.

According to this option, workers who meet the conditions for the duration of social insurance contributions as prescribed by the law on social insurance will receive a pension upon reaching the retirement age.

The retirement age for workers in normal working conditions will be adjusted according to a roadmap until reaching 62 years old for men by 2028 and 60 years old for women by 2035.

From 2021, the retirement age for workers in normal working conditions will be 60 years and 03 months for male workers, and 55 years and 04 months for female workers; thereafter, each year will increase by 03 months for male workers and 04 months for female workers.

Workers with reduced working capacity; those engaged in particularly heavy, harmful, dangerous occupations and jobs; those engaged in heavy, harmful, dangerous occupations and jobs; those working in areas with particularly difficult socio-economic conditions may retire at a lower age but not more than 05 years earlier than the prescribed retirement age at the time of retirement, unless otherwise provided by law.

Workers with high technical expertise and certain special cases may retire at a higher age but not more than 05 years later than the prescribed retirement age at the time of retirement.

Thus, if Option 2 is passed, from 2021, each year the retirement age will increase by 03 months for male teachers and 04 months for female teachers until it reaches 62 years for men by 2028 and 60 years for women by 2035.

The above provisions in the Draft Labor Code 2019 are aimed at implementing the previously set spirit in Resolution 28-NQ/TW, specifically, from 2021, to adjust the retirement age with the goal of increasing the general retirement age, gradually narrowing the gender gap in the regulation of retirement age; for special occupations, workers have the right to retire earlier or later by 5 years compared to the general retirement age.
