Recently, the Ministry of Agriculture and Rural Development has issued Circular 13/2019/TT-BNNPTNT regulating the reforestation when converting forest use purposes.
According to Article 3 of Circular 13/2019/TT-BNNPTNT, the project owner is allowed to independently organize the replacement planting of forests when changing the purpose of forest use to another purpose in the following cases:

- When converting the purpose of special-use forests, protection forests, or production forests that are natural forests to another purpose: The project owner must have an area of land without forest that is planned for the development of protection forests or special-use forests, assigned by the State for forest planting according to legal regulations.- When converting the purpose of production forests that are planted forests to another purpose: The project owner must have an area of land without forest that is planned for forest development, assigned or leased by the State for forest planting according to legal regulations.
Circular 13/2019/TT-BNNPTNT stipulates that the project owner shall develop a replacement afforestation plan following the form in Appendix I attached to this Circular. In case the forest area converted to another purpose is located in multiple provinces or centrally-run cities, separate plans shall be developed for each province or centrally-run city.
The project owner fulfills the replacement afforestation obligation when the afforested area is verified and accepted as completed according to regulations.
