This is one of the principles for conducting court sessions stipulated in Circular 02/2017/TT-TANDTC issued by the Supreme People's Court on July 28, 2017, promulgating the regulations for organizing court sessions.
Accordingly, Circular 02 stipulates the following principles to be ensured when organizing a court session:
- The court session must be conducted at the designated time, location, and with the participation of those conducting proceedings and involved parties as per the decision to bring the case to trial. In the event of a postponement of the court session, the time and location for the rescheduled session must be clearly stated in the notice for the rescheduled session.- The court session is to be held publicly, except in cases where it is necessary to maintain state secrets, traditional customs, protect individuals under 18 years of age, or uphold professional, business, personal, or family confidentiality at the rightful request of the litigant or defendant, the Court may conduct a private hearing.- The organization of the court session must ensure security, order, and the solemnity of the Court; ensure the trial is conducted equitably, democratically, strictly, objectively, and in compliance with the law; contribute to the dissemination and education of citizens to comply with the law, respect social life norms, and raise awareness in the fight against crime and other legal violations.- The Court is responsible for preparing the necessary conditions to organize the court session; all individuals, agencies, and organizations must comply with the law and facilitate the Court in organizing the session in conformity with the law.- For court sessions handling cases within the jurisdiction of the Family and Juvenile Court, the organization of the court session must further ensure a friendly and appropriate atmosphere, ensuring the best interests of individuals under 18 years of age.
