Below are the details of training and instruction on the management and use of weapons, military explosives, and support tools in Vietnam from January 1, 2025, as stipulated in Decree 149/2024/ND-CP.
Training content on the management and use of weapons, military explosives, and supporting tools in Vietnam from January 1, 2025
On November 15, 2024, the Government of Vietnam issued Decree 149/2024/ND-CP providing guidance on the Law on Management and Use of Weapons, Explosive Materials, and Suppoting Tools 2024.
As stipulated in Article 13 of Decree 149/2024/ND-CP, the content, duration, location, and funding for organizing training and instruction on the management and use of military weapons, explosive materials, and suppoting tools are as follows:
- Training and instruction on the management and use of military weapons, explosive materials, and suppoting tools must align with the registered training and instruction content regarding the subject, type of weapons, explosive materials, and suppoting tools.
- Training content includes:
+ Legal provisions on the management and use of military weapons, explosive materials, and suppoting tools;
+ Structure, features, and functions of each type of weapon, explosive material, and suppoting tool;
+ Management, preservation, maintenance, assembly, and disassembly of weapons, explosive materials, and suppoting tools; management of warehouses, storage places for weapons, explosive materials, and suppoting tools;
+ Skills in using military weapons, explosive materials, and suppoting tools.
- The duration of training and instruction on the management, use of military weapons, and explosive materials is 10 working days; management, use of sports weapons, suppoting tools, and management of warehouses, storage places for weapons, explosive materials, and suppoting tools is 5 working days.
- The venue for organizing training and instruction must have facilities, equipment, and tools suitable for the instruction activities; ensuring security, safety, fire prevention, and environmental protection. Real ammunition firing tests must be organized at shooting ranges as prescribed.
- The expense for organizing training and instruction is the responsibility of the agency, organization, or enterprise requesting the instruction.
The standards for trainers in the management and use of military weapons, explosive materials, and suppoting tools are specifically prescribed in Article 14 of Decree 149/2024/ND-CP:
- A bachelor's degree within the educational system of the Ministry of Public Security, Ministry of Defense, or middle-level military engineering specialization or above.
- Skills, technical expertise, and at least 2 years of practical experience in training and instruction in the management and use of military weapons, explosive materials, and suppoting tools.
Refer to Decree 149/2024/ND-CP which takes effect from January 1, 2025, except for the following provisions:
Provisions in Article 9, Article 10, and Article 11 of Decree 149/2024/ND-CP take effect from July 1, 2025; provisions in Article 7 of Decree 149/2024/ND-CP take effect from January 1, 2026.
Decree 79/2018/ND-CP of the Government of Vietnam provides detailed provisions on certain aspects and enforcement measures of the Law on Management and Use of Weapons, Explosive Materials, and Suppoting Tools 2017 that cease effectiveness from the date Decree 149/2024/ND-CP comes into effect, except for provisions in Article 7, Article 8, Article 9, Article 10, and Article 11 which remain effective until June 30, 2025.
