Decree 16/2018/ND-CP on the declaration of maritime routes and traffic separation schemes in Vietnamese territorial waters was promulgated on February 2, 2018. This Decree specifically stipulates the traffic separation schemes in Vietnamese territorial waters.
Pursuant to the provisions of Article 7 of Decree 16/2018/ND-CP, the traffic zoning in the territorial waters of Vietnam is implemented as follows:
- Vessels passing through the territorial waters of Vietnam but not entering the internal waters of Vietnam must follow the maritime routes in the territorial waters of Vietnam as announced.
- Vessels transporting goods, passengers, and luggage or military vessels and other types of non-commercial vessels passing through the territorial waters and internal waters of Vietnam to enter Vietnamese seaports must navigate the correct routes and perform vessel procedures as prescribed.
- Vessels passing through the territorial waters and internal waters of Vietnam without arriving at a Vietnamese seaport must the captain of that vessel immediately notify the regional Maritime Port Authority of the reason and purpose for entering the internal waters of Vietnam under the following circumstances:
- To provide emergency aid to crew members or passengers on the vessel;- To avoid or shelter from a storm;- To carry out search and rescue operations; to transfer rescued people, property, or vessels from the sea;- To mitigate the consequences of maritime incidents or accidents involving vessels;- Other urgent cases as stipulated by law.
