Below are the regulations on the Traffic Police's authority to conduct public patrol and monitoring in combination with undercover operations according to the new regulations in Vietnam from January 1, 2025.

Article 7 of Circular 73/2024/TT-BCA has stipulated the organization of forces directly conducting public patrols and inspections combined with undercover operations on roadway traffic routes as follows:

(1) The Traffic Police team is organized with a unit of officers in plain clothes, using undercover vehicles to cooperate with the unit of officers conducting public patrols and inspections according to the plan issued by the competent authority as stipulated in clauses 1, 2, and 3 of Article 10 of Circular 73/2024/TT-BCA to carry out the task of patrolling, inspecting, and handling violations on the assigned routes and localities.

(2) Cases of public patrol and inspection combined with undercover operations include:

- The use of technical equipment and professional tools to enhance the efficiency of ensuring road traffic order and safety;

- Combating crime; addressing complex situations of security, order, and road traffic safety.

(3) Requirements for public patrol and inspection combined with undercover operations

- There must be a patrol and inspection plan issued by a competent authority as stipulated in clauses 1, 2, and 3 of Article 10 of Circular 73/2024/TT-BCA. The content of the plan should clearly state the implementation method; forces; attire; communication method, time, routes, localities of patrol and control; transportation; technical equipment and professional tools; weapons, support tools, and other technical means used for patrol and control.

The Director of the Traffic Police Department; Directors of Provincial/Municipal Police (hereinafter referred to as the Provincial Police Director); Heads of the Road Traffic Patrol and Inspection Guidance Department, Road and Railway Traffic Police Department; District Police Chiefs as specified in clauses 1, 2, and 3 of Article 10 of Circular 73/2024/TT-BCA decide on the attire of the Police, plain-clothes, and undercover vehicles during public patrol and inspection combined with undercover operations;

- The undercover officer unit and the public patrol and inspection officer unit in the Traffic Police team must maintain an appropriate distance to ensure the prompt and lawful handling of violations.

The undercover officer unit is tasked with direct observation, using technical equipment and professional tools to monitor the situation of road traffic order and safety, detecting legal violations concerning road traffic order and safety, and other legal violations; upon detecting violations, they must immediately notify the public patrol and inspection officer unit to stop the vehicle, inspect, and handle according to regulations.

In case of detecting serious violations concerning road traffic order and safety, security, social order, if not promptly prevented will cause dangerous consequences to society, damage to the assets of agencies, organizations, individuals, harm to the lives and health of traffic participants, the People's Police ID card is used to request the vehicle to stop and notify, urging the public to cooperate and immediately prevent the violation; notify and cooperate with the public patrol and inspection officer unit to address at the site where the violation is detected or bring the violator to the nearest Police agency headquarters for resolution according to regulations.
