Trading in Antiques Also Requires a Specialized University Degree

the Government of Vietnam has just issued Decree No. 142/2018/ND-CP amending certain regulations on business investment conditions within the scope of state management by the Ministry of Culture, Sports and Tourism.

To be specific:, Decree 142/2018/ND-CP amends certain detailed regulations implementing several provisions of the Law on Cultural Heritage and the Law amending and supplementing several provisions of the Law on Cultural Heritage; business conditions for relic examination and practice in preservation, restoration, and rehabilitation of historical - cultural relics, landscapes; business conditions for sports activities...

According to the provisions of Clause 1, Article 25 of Decree 98/2010/ND-CP, the owners of shops selling artifacts, antiques, and national treasures must meet the following conditions: Be Vietnamese citizens with permanent addresses in Vietnam; Have a practicing certificate for buying and selling artifacts, antiques, and national treasures; Have a shop with adequate space suitable for displaying artifacts, antiques, and national treasures; Have sufficient means to display, preserve, and protect artifacts, antiques, and national treasures.

Now Decree 142/2018/ND-CP amends the condition to "have a shop for display"; simultaneously abolishes the condition "Have sufficient means to display, preserve, and protect artifacts, antiques, and national treasures."

According to Decree 142/2018/ND-CP, the certificate for practicing in buying and selling artifacts, antiques, and national treasures is only issued to individuals with a university degree or higher in one of the training disciplines related to cultural heritage, history (archaeology, cultural studies), fine arts, Han Nom, ethnology, paleoanthropology, paleontology (animal, plant), geology; or who are members of social - professional organizations related to the above training disciplines and have engaged in collecting antiques. Previously, Decree 98/2010/ND-CP only required professional qualifications or understanding of artifacts, antiques, and national treasures.

At the same time, Decree 142/2018/ND-CP also reduces the business conditions for relic examination from 4 conditions to 2 conditions. According to the new Decree, a relic examination business facility only needs to ensure conditions such as: Having equipment and means for conducting examinations suitable for the registered field; Having at least 03 experts in antique examination in accordance with guidelines from the Ministry of Culture, Sports and Tourism.

Reduction of statutory capital for film production business

Decree 142/2018/ND-CP stipulates that the statutory capital for a film production business is 200,000,000 VND instead of 1,000,000,000 VND as in Decree 54/2010/ND-CP.

In addition, Decree 142/2018/ND-CP also amends business conditions for sports activities. According to the new regulations, a business facility for extreme sports activities must have enough specialized staff: A sports training instructor as prescribed in Article 6 of this Decree; Rescue staff; On-site medical staff or have a written agreement with the nearest medical facility to provide first aid for participants in extreme sports activities in urgent cases.

For conditions regarding sports training instructors, Decree 142/2018/ND-CP specifies that the sports training instructor must meet one of the following conditions:

- Be a coach or athlete suitable for the registered sports activity with a ranking from level 2 or equivalent or higher;- Have a degree in physical education and sports from intermediate level or higher, suitable for the registered sports activity;- Be professionally trained in sports according to the regulations of the Minister of Culture, Sports and Tourism.
