Regarding this issue, LawNet would like to answer as follows:
On October 13, 2023, the Government issued Official Dispatch 965/CD-TTg on removing obstacles in implementing land management and use, land allocation, and land valuation.
To promptly remove difficulties and obstacles, clear and promote land resources, promote the implementation of socio-economic development projects, remove difficulties for the real estate market, and ensure the legal and legitimate rights and interests of people and businesses, the Prime Minister requests the Minister of Natural Resources and Environment to urgently implement the following contents:
- Listen, research, and absorb opinions from localities, organizations, associations, businesses, and individuals in the process of completing the Draft Revised Land Law, so that the provisions of the amended Land Law when promulgated, come to life; Regulations must be clear, transparent, easy to understand, easy to implement, easy to monitor, and easy to inspect.
Strengthen decentralization and decentralization of land allocation, land lease, and change of land use purposes; strengthen the personal responsibility of the leader; at the same time, promote inspection and supervision; definitely do not cause trouble for people and businesses; and meet practical requirements.
- Before October 25, 2023, submit to the Government for consideration and promulgation of a Decree amending and supplementing Decree 44/2014/ND-CP, scientifically oriented, close to reality, simplifying procedures, minimizing intermediaries, clear regulations, easy to understand, convenient for implementers and do not cause loss to the state budget when evaluating land and deciding on land prices; do not let negative corruption occur; do not be afraid of being wrong; do not be afraid of responsibility; do not dare to do anything.
- Before October 31, 2023, submit to the Prime Minister a study to adjust the National Land Use Planning criteria for the period 2021–2030, with a vision to 2050, and the 5-year national land use plan 2021–2025 has been allocated to localities in Decision 326/QD-TTg in 2022 to meet the local land use needs of implementing socio-economic development projects and works, clearing resources, and economic recovery in the coming time.
- Guide localities to implement the work of issuing certificates of land use rights and ownership of houses and assets attached to land following the principle of simple procedures, not causing trouble or harassment to people and businesses during the implementation process.
- Develop plans for specialized inspections and unscheduled inspections within authority to prevent, stop, and remedy land-related violations in ministries, branches, and localities.
According to Official Telegram 965/CD-TTg, the Prime Minister requested the Chairmen of the People's Committees of provinces and centrally run cities to perform the following tasks:
- Focus on directing land valuation work and deciding land prices according to authority, according to the Government's direction in Resolution 73/NQ-CP in 2023, not cause difficulties, delays, or affect the progress of investment project implementation to free up resources and promote socio-economic development.
- Direct the province's natural resources and environment agency to carry out administrative procedures for granting certificates of land use rights, housing ownership rights, and assets attached to land; transferring land use purposes to organizations and people must be done quickly and in accordance with regulations; and regulating the discipline and public service ethics of officials and civil servants in the process of implementing and resolving land-related administrative procedures.
- Review and evaluate the results of implementing the province's land use targets allocated by the Prime Minister; Proposed land use needs must ensure effective and economical exploitation and use of land in accordance with regulations; Do not waste land resources.
