Submitting to the Government the amended Decree Decree 44/2014/ND-CP on land valuation before June 30, 2023 is the content at Official Telegram 469/CD-TTg in 2023 on dismantling and promoting the safe, healthy and sustainable development of the real estate market in Vietnam.

According to Official Telegram 469/CD-TTg, the Government requires the Ministry of Natural Resources and Environment to address the following matters:

- Advising and submitting to the Government for promulgation a Decree amending and supplementing lawnet.vn/vb/Nghi-dinh-44-2014-ND-CP-quy-dinh-ve-gia-dat-384E8.html dated on stipulating land valuation methods; building and adjusting land price brackets and land price lists; specific land valuation and land price determination consultancy activities to amend and supplement the order and procedures for specific land price determination in case the People's Committee of the province authorizes the People's Committee of the district to decide on a specific land price, submit it to the Government for promulgation before June 30, 2023. Timely guidance is needed for localities to solve problems related to land price determination.

- Reviewing shortcomings and problems of Circulars to amend and supplement according to their competence, especially Circular 36/2014/TT-BTNMT detailing land valuation methods; building and adjusting land price lists; and specific land valuation and land price determination consultancy to urgently amend, supplement, and promulgate in June 2023 together with the Decree amending and supplementing Decree 44/2014/ND-CP.

- Directing, urging, and guiding localities to remove difficulties and obstacles in land price determination, planning, and the annual land use plan; especially at the district level and the implementation of compensation and site clearance, before June 30, 2023.

- Inspecting and urging localities to urgently issue specific regulations according to their competence to effectively implement the provisions of the law on land, such as: specifying conditions for separation of land parcels, conditions for consolidating land parcels according to each type of land, and the minimum area to be divided for each type of land, before June 15, 2023.

- Assuming the prime responsibility for, and coordinating with the Ministry of Planning and Investment and relevant ministries and branches in, directing and guiding localities to remove difficulties and obstacles in the equitization of enterprises to change land use purposes for project implementation; the transfer of land use rights with infrastructure to people in projects located in wards of special urban centers and grade I urban centers has been approved before the effective date of Decree 148/2020/ND-CP, before June 30, 2023.

- Assuming the prime responsibility for, and coordinating with concerned ministries, branches, and agencies in, directing and urging localities in the implementation of the provisions of the law on land; especially the regulations related to the investment and construction of real estate projects, and proposing solutions to remove difficulties for the real estate market in the field of management for problems arising, beyond the authority.

In the event that it is required to report to and consult the Prime Minister, it must clearly propose solutions, based on the principle that the problem falls within the competence of the level at which it must be resolved.

To focus on studying amendments to the Law on Housing, the Law on Real Estate Business in Vietnam

The Prime Minister of Vietnam requests that the Ministry of Construction address the following matters:

- Focusing on researching and amending the Law on Housing 2014 and the Law on Real Estate Business 2014 in accordance with the Law and Ordinance Development Program of the National Assembly.

- Assuming the prime responsibility for, and coordinating with the Ministry of Planning and Investment in, guiding localities to remove, difficulties and obstacles in the formulation and approval of master plans; the implementation of adjustments to the planning; and the application of the planning level when approving the project investment policy, before June 15, 2023.

- Reviewing, supplement (if any) and finalize the draft Decree amending and supplementing a number of articles of Decrees in the field of state management of the Ministry of Construction, on the following contents: formulation, appraisal, approval and management of urban planning; granting architects practicing certificates; urban development investment management; identification as the investor of a commercial housing construction investment project; renovating and rebuilding apartment buildings; conditions for construction judicial assessment and specialized experimentation; construction contract; construction investment cost management; on quality management, construction and maintenance of construction works; construction project management; ...

- Assuming the prime responsibility for, and coordinating with the Ministry of Public Security and relevant ministries, branches, and agencies in, reviewing difficulties and obstacles for contents related to fire prevention and fighting in construction works to propose solutions to remove before June 30, 2023.

- For difficulties and problems in the arrangement of land funds for social housing development, the Ministry of Construction shall guide localities to deal with them in accordance with the provisions of the law.

- Coordinating with the State Bank of Vietnam and relevant ministries, branches, localities, and agencies to effectively implement the VND 120,000 billion credit program according to Resolution 33/NQ-CP dated March 11, 2023.

- Coordinating with relevant ministries, branches, localities, and agencies to propose handling and removing difficulties and obstacles of the real estate market for problems that arise, beyond their competence. In the event that it is required to report to and consult the Prime Minister, it must clearly propose solutions, based on the principle that the problem falls within the competence of the level at which it must be resolved.
