Regarding this issue, LawNet would like to answer as follows:
On November 20, 2023, the Government issued Resolution 195/NQ-CP on stopping the credit program for students with difficult family circumstances to buy computers and equipment for online learning in Decision 09/2022/QD-TTg.
From November 20, 2023, the Government approved the policy of stopping the credit program for pupils and students with difficult family circumstances to buy computers and equipment for online learning in Decision 09/2022/QD-TTg.
At the same time, assign the Prime Minister to consider and issue a Decision to abolish all Decision 09/2022/QD-TTg on the basis of Report No. 154/TTr-BTC dated July 19, 2023.
Resolution 195/NQ-CP takes effect from the date of signing.
**Some regulations on stopping credit programs for students with difficult family circumstances to buy computers and equipment for online learning
(1) Regarding the borrower
Eligible borrowers to buy computers and equipment for online learning in Decision 09/2022/QD-TTg are students at all levels who are studying at educational institutions under the national education system according to the provisions of the Law on Education and meet the statutory conditions;
Or pupils and students studying at universities (or university equivalents), colleges, intermediate schools, and vocational education centers that are established and operating according to the provisions of Vietnamese law and meet the statutory conditions.
(2) Regarding loan conditions
Specifically, students must meet the following loan conditions:
- Be a member of a household belonging to one of the following categories: poor households, near-poor households, households with an average standard of living according to the standards prescribed by law, or households in difficult circumstances due to the impact of the COVID-19 pandemic (having a parent or parent who died due to the COVID-19 pandemic);
- Do not have a computer or equipment that meets the requirements for online learning and have not received the policy to support computers and online learning equipment in any form.
(3) Loan method
- Loans to pupils and students are carried out in the form of loans through households. The representative of the student's household is the person who borrows and transacts with the Bank for Social Policies.
- In case the subject at Point b, Clause 1, Article 3 of Decision 09/2022/QD-TTg, is 18 years old, he/she can directly apply for a loan at the Social Policy Bank where he/she resides or where the school is headquartered if the household no longer has any members aged 18 or older or the remaining members no longer have the ability to work or have full civil act capacity according to the provisions of law.
- Lending by the Bank for Social Policies is carried out by entrusting socio-political organizations under trust contracts or directly lending to borrowers.
(4) Interest rate and loan term
- Loan interest rate: 1.2%/year; the overdue debt interest rate is equal to the interest rate for poor households at the time of borrowing.
- Loan term: Maximum of 36 months.
In cases where students directly take out loans in their names as prescribed in Clause 2, Article 4, Decision 09/2022/QD-TTg:
(i) At the time of loan, if the expected completion time of the course is 24 months or more, the maximum loan term is calculated from the loan date to the end of 12 months after the expected completion of the course;
(ii) The student's expected completion time for the course in (ii) is determined according to the school's confirmation.
