How have some problems regarding the implementation of the National Target Program been addressed by the Ministry of Finance of Vietnam?

The content mentioned in Official Dispatch 11449/BTC-HCSN of 2023 answers local questions about implementing the National Target Program for the period 2021-2025 according to Notice 392/TB-VPCP issued by the Ministry of Finance.
Implementing the direction of Deputy Prime Minister Tran Luu Quang in Notice 392/TB-VPCP dated September 24, 2023 of the Government Office on a preliminary review of the implementation of national target programs from 2021 to present and key tasks and solutions in the coming time.
Based on assigned functions and tasks, the Ministry of Finance answers local questions related to the 03 National Target Programs for the period 2021–2025 so that localities can know and implement them.
Including answers to questions about the National Target Program for socio-economic development in ethnic minority and mountainous areas.
Specifically, content of recommendation No. 7 (Gia Lai province):
- Content of the first recommendation: Propose additional instructions on procedures and settlement documents for startup and business start-up models for localities to implement;
- Content of the second recommendation: Proposal to supplement payment content for nutrition collaborators at the National Target Program for Socio-Economic Development of Ethnic Minorities and Mountainous Areas.
With the above recommendations, the Ministry of Finance responded as follows:
In Clause 5, Article 3, Circular 55/2023/TT-BTC regulates the control of expenditures, advances, and payment of funds:
“The control of expenditures, advances, and payment of funds is carried out in accordance with the provisions of Decree 11/2020/ND-CP dated January 20, 2020 of the Government on administrative procedures in the field of State Treasury; Circular 62/2020/TT-BTC dated June 22, 2020 of the Ministry of Finance guiding the control and payment of regular expenses from the state budget through the State Treasury.”
Therefore, it is recommended that localities base their decisions on the regulations in Decree 11/2020/ND-CP and Circular 62/2020/TT-BTC to carry out payment and settlement for startup and business start-up models.
With the second recommendation: Decision 1719/QD-TTg dated October 14, 2021, of the Prime Minister approving the program [6] does not stipulate payment content for nutrition collaborators at Project 7. Therefore, the Ministry of Finance has no basis to regulate this content in Circular 55/2023/TT-BTC.
In addition, the Ministry of Health is the agency in charge of guiding the implementation of Project 7. Therefore, if there are still any problems, the Province is requested to send the above recommendations to the Ministry of Health for guidance according to its authority.
Content of recommendation No. 7 (Ha Tinh province): Proposal to promptly amend and supplement Joint Circular 14/2014/TTLT-BTC-BTP dated January 27, 2014 of the Ministry of Finance and Ministry of Justice on the preparation of estimates, management, use, and settlement of state budget funds to ensure the dissemination and education of law and standards of access to law for people at the grassroots level.
The Ministry of Finance responded as follows:
On August 18, 2023, the Ministry of Finance issued Circular 56/2023/TT-BTC on the preparation of estimates, management, use and settlement of funds to ensure dissemination and education of the law, legal access standards and mediation at the grassroots level replacing Joint Circular 14/2014/TTLT-BTC-BTP. Circular 56/2023/TT-BTC takes effect on October 6, 2023.
The Ministry of Finance would like to provide information for localities to know and organize implementation according to regulations.
