Regarding this issue, LawNet would like to answer as follows:

On December 19, 2023, the General Department of Taxation issued Official Telegram 10/CD-TCT on the drastic implementation of electronic invoicing for petroleum retail business activities.

To continue to effectively implement Official Telegram 1284/CD-TTg of the Prime Minister, Official Dispatch 13348/BTC-TCT of the Ministry of Finance, the Director General of the General Department of Taxation requests the Director of the Provincial and City Tax Departments to continue to direct and urgently carry out the following tasks:

(1) For localities that do not have written directives from the People's Committee: The Tax Department is responsible for advising the People's Committee to direct departments and branches to proactively coordinate with tax authorities to immediately deploy synchronous, effective solutions; drastically request petroleum retail business units to issue electronic invoices after each sale in accordance with the law and directions of the Prime Minister and the Ministry of Finance.

(2) Continue to coordinate closely with local departments and agencies to review and grasp the current status of infrastructure, equipment, and progress in implementing electronic invoices according to each sale at each gasoline station; Immediately organize working sessions with petroleum retail business units; publicly invite solution-provider companies to share successful implementation experiences and discuss effective solutions;

Advise and propose to the Provincial and City People's Committees to promptly remove difficulties and obstacles (if any) to successfully implement the issuance of electronic invoices for each sale for petroleum retail business activities in the area and ensure progress according to the direction of the Prime Minister in Official Telegram 1284/CD-TTg mentioned above.

(3) Drastically deploy tasks to leaders of the Tax Department, leaders of Tax Departments and Sub-Departments, and specifically to civil servants managing the unit to work on and propagate policies and legal regulations. on electronic invoices to each business and retail petrol and oil store so that units can clearly understand, be fully aware of their responsibilities, and commit to issuing electronic invoices after each sale according to the law. Attach responsibility for inspection, supervision, and handling of violations for units that do not comply or intentionally do not comply.

(4) The Department of Taxation specifically reports on the implementation of contents and tasks under the direction of the Ministry of Finance and the General Department of Taxation in Official Dispatch 13348/BTC-TCTOfficial Dispatch 5080/TCT-DNLOfficial Dispatch 5468/TCT-DNL and sends daily implementation results to the General Department of Taxation at the email address: nttbinh01@gdt.gov.vn.

It is known that on December 1, 2023, the Prime Minister issued Official Telegram 1284/CD-TTg requesting ministries, branches, and localities to strengthen the management and use of electronic invoices for petroleum retail business activities; The completion date is December 2023.

Implementing the Prime Minister's direction, the Ministry of Finance issued Official Dispatch 13348/BTC-TCT dated December 4, 2023, requesting the attention of the Chairman of the People's Committees of provinces and centrally run cities to direct and coordinate closely and regularly with the Ministry of Finance in implementing electronic invoices for the petroleum retail business.

The General Department of Taxation also issued Official Dispatch 5080/TCT-DNL dated November 13, 2023, and Official Dispatch 5468/TCT-DNL dated December 5, 2023, directing the Tax Department of provinces and centrally run cities to advise the People's Committee to direct local agencies and departments to coordinate with tax authorities to urgently deploy to businesses and petroleum retail stores to issue e-invoices after each sale according to regulations.
