Regarding this issue, LawNet would like to answer as follows:
On August 21, 2023, the Prime Minister issued Decision 977/QD-TTg on recognizing communes and wards as Safety Zones in Ho Chi Minh City.
Accordingly, the Prime Minister recognized 09 communes and wards in Cu Chi District and District 12 of Ho Chi Minh City as communes and wards in the Central Safety Zone during the resistance war against the US, including:
- Cu Chi district: Nhuan Duc commune; Phu My Hung commune; Phu Hoa Dong commune; An Phu commune; An Nhon Tay commune; Pham Van Coi commune.
- District 12: An Phu Dong ward; Thanh Loc ward; Thanh Xuan ward.
Then. The above-mentioned Safety Zone communes and wards will implement preferential policies according to current regulations.
Decision 977/QD-TTg takes effect from the date of signing.
According to Point a, Clause 2, Article 1 of Decision 897/QD-TTg in 2016, to be identified as a Safe Zone commune, those communes must meet three of the following five criteria:
- Criterion 1: Be directed by party committees from the Regional Party Committee, Military Region Committee or higher to build a safe revolutionary zone (where topographical, terrain, political, military, socio-economic, and population conditions exist and ensure safety for the Party's revolutionary leadership activities during the resistance war against France and America).
- Criterion 2: Place of residence (raised, hidden, kept secret), work and leadership activities, directing the building of revolutionary movements in the resistance war against the French and Americans of comrades and officials of the Party, State, Vietnam Fatherland Front, and socio-political organizations from the Zone and Military Region level and above.
- Criterion 3: Place where particularly important events took place, with strategic decisions of the Party that were turning points in the stages of the two resistance wars against the French and the Americans, or where the headquarters of agencies, organizations, units of the Party, State, Vietnam Fatherland Front, and socio-political organizations at the Zone and Military Region level or higher are located, diplomatic headquarters (Embassies, Consulates General,...) of foreign countries, Front Command agencies at campaign level in the resistance war against France and America.
- Criterion 4: Place of stationing, training, regrouping, and transit of armed forces (army, police) from company level or higher; where there are warehouses for storing food, weapons, ammunition, military equipment, etc. during the resistance war against the French and the Americans to serve the Front at campaign level or Military Region level or higher.
- Criterion 5: Where there is a strong revolutionary base and movement in the resistance war against the French and the Americans; at the same time, the local armed forces have proactively or coordinated with the regular armed forces to organize enemy battles to protect the safety of officials, agencies, and organizations of the Party and the State in the area or where important victorious battles took place, contributing to creating an advantageous battlefield situation for the revolution and resistance in the area and surrounding areas.
Based on the criteria for determining Safe Zone communes, the Provincial People's Committee directs specialized agencies and relevant district-level People's Committees to guide the Commune-level People's Committee to prepare dossiers to request recognition of the Commune Safety Zone according to the following procedures:
- The People's Committee at the commune level prepares a scientific dossier to recognize the Commune Safety Zone, reports to the Standing Committee of the Party Committee at the same level, and prepares a report attached to the dossier submitted to the District People's Committee to request the competent authority to recognize the Safe Zone commune.
- After receiving the application for recognition of the Commune Safety Zone from the Commune People's Committee to ensure compliance with regulations, the District People's Committee organizes the appraisal of documents, reports to the Standing Committee of the Party Committee at the same level, and prepares a report (attached with the documents) to submit to the Provincial People's Committee.
The district-level appraisal council has from 05 to 07 people, including: representatives of leaders of the People's Committee, relevant departments, divisions, and organizations of the district, and representatives of the commune-level People's Committee with application documents.
- After receiving the application for recognition of the Commune Safety Zone from the District People's Committee to ensure compliance with regulations, the Provincial People's Committee will organize the appraisal of the application (Department of Home Affairs presides and coordinates with relevant agencies and units to appraise), report to the Standing Committee of the Party Committee at the same level, prepare a report to the Prime Minister (attached with documents), and send it to the Ministry of Home Affairs for appraisal.
- After receiving the application for recognition of Safe Zone Commune from the Provincial People's Committee to ensure compliance with regulations, the Ministry of Home Affairs presides over and coordinates with the Ministry of National Defense and relevant ministries and agencies to organize an appraisal and submit it to the Prime Minister for consideration and decision.
- In case the dossier is not guaranteed according to regulations, within 15 working days from receipt of the dossier, the receiving agency must provide a written response and instructions for localities and establishments to know and implement.
