Regarding this issue, LawNet would like to answer as follows:

On December 20, 2023, the Ministry of Transport issued Decision 1664/QD-BGTVT on the Ministry's 2024 Legal Support Plan for Small and Medium Enterprises.

To promulgate the Ministry of Transport's 2024 Legal Support Plan for Small and Medium Enterprises in Vietnam

Implementing Decree 55/2019/ND-CP on legal support for small and medium-sized enterprises, the Ministry of Transport issued the Legal Support Plan for small and medium-sized enterprises in 2024 as follows:

Legal support plan for small and medium enterprises in 2024 with the purpose of:

- Provide legal information for businesses; disseminate and foster business law knowledge for business managers; and foster business legal skills.

- Ensure proactiveness and consistency in the effective direction, administration, implementation, and coordination of legal support activities for businesses.

- Fully support the basic content of current legal regulations and the application of legal documents in production and business activities; create fundamental changes in awareness, consciousness, and habits of law compliance; Limit risks and legal problems in the enterprise's business activities.

At the same time, this Plan must also ensure the following requirements:

- Ensure correct content and form as prescribed in the Law on Support for Small and Medium Enterprises and Decree 55/2019/ND-CP on legal support for small and medium enterprises; at the same time, ensure good implementation of state management in the field of transportation.

- Integrate and combine legal support activities for small and medium-sized enterprises with activities of propaganda, dissemination, legal education, support and information provision for businesses, and other state management activities.

- Legal information is guaranteed to be accurate, fast, timely, and consistent with business requirements.

- Promote propaganda and strengthen coordination among state agencies; between state agencies and representative organizations of businesses, in organizing legal support activities for small and medium-sized enterprises.

Regarding the form and content of the Plan's key legal support:

- Support, provide information, and guide the implementation of new regulations in legal documents drafted by the Ministry of Transport and submitted to competent authorities for promulgation or promulgated according to authority in the field of state management of the Ministry of Transport.

- Provide legal answers to businesses according to the regulations issued with Decision 1127/QD-BGTVT in 2021 on implementing legal answers in legal support for small and medium-sized enterprises and other related regulations.

- Receive, research, and review proposals from businesses to amend, supplement, issue new ones, or submit them to competent state agencies for consideration and decision on amendments and supplements, or promulgate new legal documents to create favorable conditions for businesses to operate and develop in accordance with the provisions of the Constitution and law.

Regarding the implementation of the Plan, the Departments and Bureaus under the Ministry must deploy and concretize the legal contents that need support according to the functions and tasks of the agencies and units according to the Appendix assigning tasks to implement the Legal Support Plan for Small and Medium Enterprises issued together with Decision 1664/QD-BGTVT; choose the appropriate form according to the provisions of the Law on Support for Small and Medium Enterprises and Decree 55/2019/ND-CP on legal support for small and medium enterprises.

Preside and coordinate with relevant units to deploy support for small and medium-sized enterprises with legal content in the field of state management of agencies and units.

Guide, monitor, urge, and direct affiliated agencies and units to carry out legal support activities for businesses in their management areas in accordance with the 2024 legal support plan for small and medium enterprises of the Ministry and Departments.

Ensure adequate resources to effectively carry out legal support for small and medium-sized enterprises.

Summarize and report to the Ministry (through the Department of Legal Affairs) on the situation and results of implementing legal support for small and medium enterprises.
