Regarding this issue, LawNet would like to answer as follows:

On October 26, 2023, the Prime Minister issued Decision 1250/QD-TTg on the Implementation Plan for the Law on Prices 2023.

To organize a review of current legislative documents on prices in Vietnam

To ensure implementation of the Law on Prices 2023, the Prime Minister requested to organize a review of current legal documents on prices to propose amendments, supplements, abolitions, or new promulgations in accordance with the provisions of the Law on Prices 2023.

Specifically:

- The Ministry of Finance presides over and coordinates with ministries, branches, and localities to systematize and list current legal documents related to the Law on Prices 2023 (including documents from the Government Decree, Prime Minister's Decision, Circular, Joint Circular, and Decision of the Provincial People's Committee) under state management authority and price decision authority of ministries, branches, and localities to have a basis for reviewing amendments, supplements, replacements, abolitions, or new promulgations, ensuring compliance with regulations of the Law on Prices 2023.

Ministries, branches, and localities should proactively implement and send a list of documents to the Ministry of Finance before November 30, 2023, to synthesize, monitor, urge, and coordinate review according to regulations.

- Ministries, branches, and localities, based on the List of documents and the Law on Prices 2023, organize and review legal documents; based on the review results, proactively amend, supplement, replace, abolish, or promulgate new ones according to authority or submit them to competent authorities according to regulations, ensuring that documents take effect concurrently with the Law on Prices 2023.

In particular, for new goods and services added to the list; For goods and services that have changed authority or form of pricing, it is necessary to be proactive in establishing price plans and appraising price plans to have a basis for issuing price decision documents promptly and ensuring quality.

Based on the implementation results, ministries, branches, and localities will have a consolidated report with a list of documents sent to the Ministry of Finance before May 5, 2024.

- For contents that need to be amended, supplemented, replaced, abolished, or newly promulgated in Review Report 20/BC-TCT dated January 28, 2022 of the Prime Minister's Working Group on reviewing legal documents; Opinions of the Deputy Prime Minister in Official Dispatch 1172/VPCP-PL dated February 24, 2022 on the results of 2021 activities of the Prime Minister's Working Group on reviewing legal documents; and new contents arising during the review process under this Plan. The Ministry of Finance, ministries, branches, and localities carry out the following:

- For documents that have been included in the Government's Working Program and the Program for developing legal documents for ministries, branches, and localities: the drafting agency is responsible for updating the reviewed content, amending, supplementing, and completing it in accordance with regulations, and is responsible to the Government and Prime Minister for implementation results.

- For documents that are not included in the Government's Working Program or the Program for developing legal documents for ministries, branches, and localities: Ministries, branches, and localities proactively review and report to competent authorities to include them in the Program for developing legal documents or send them to the Ministry of Finance for synthesis to update, amend, supplement, or abolish the Decree detailing a number of articles of the Law on Prices 2023 on price management and regulation, the Decree regulating price appraisal in accordance with regulations; be responsible to the Government and Prime Minister for implementation results.

Purposes and requirements of the Implementation Plan of Law on Prices 2023

- Purpose: Organize and implement the Price Law 2023 in a timely, synchronous, unified, and effective manner. Determine the work content, completion deadline, and responsibilities of relevant agencies and organizations in organizing and implementing the Law on Prices 2023.

- Request

+ Ensuring unified direction of the Government and Prime Minister; close coordination between ministries, branches, localities, and relevant agencies in organizing and implementing the Law on Prices 2023.

+ The heads of agencies, organizations, and assigned units must actively and proactively implement the plan on schedule, ensuring quality, practicality, and efficiency.
