To be specific, in the Draft Law on Environmental Protection (revised 2020), the scope of subjects required to conduct SEA and EIA in Vietnam has been narrowed as follows:
Narrowing the scope of subjects required to conduct SEA according to Article 33 of this Draft:
Adjust subjects required to conduct SEA by excluding plans and including subjects such as draft laws, ordinances, national target programs with policies, and content related to environmental protection. Narrow the subjects to only national-level strategies for sector and field development.
Narrowing the scope of subjects required to conduct EIA according to Article 38 of this Draft:
The scope of subjects required to conduct EIA is narrowed to include only investment projects that use large areas of land or water surfaces, adversely affect important natural landscapes, ecosystems, biodiversity, and projects that generate large waste with the potential to cause environmental pollution; the specific list to be regulated by the Government of Vietnam.
Thus, according to the new Draft, the subjects required to conduct environmental impact assessments and strategic environmental assessments have been narrowed, ensuring that environmental evaluation is conducted on the correct subjects and for the right purposes.
