Regarding this issue, LawNet would like to answer as follows:

On September 29, 2023, the Minister of Natural Resources and Environment issued Circular 11/2023/TT-BTNMT promulgating National Technical Regulations on national topographic maps at scale 1:250,000.

To issue national technical regulations on national topographic maps at a scale of 1:250,000 in Vietnam

Specifically, the Ministry of Natural Resources and Environment issued National Technical Regulations on national topographic maps at scale 1:250,000, code QCVN74:2023/BTNMT attached to Circular 11/2023/TT-BTNMT.

Circular 11/2023/TT-BTNMT takes effect on March 29, 2024.

- Regulations for topographic maps at scale 1:250,000 in Decision 11/2006/QD-BTNMT in 2006 of the Minister of Natural Resources and Environment on promulgation of topographic map symbols at scales 1:250,000, 1:500,000, and 1:1,000,000 will expire on the effective date of Circular 11/2023/TT-BTNMT.

- Regulations for topographic maps at scale 1:250,000 in Decision 09/2006/QD-BTNMT promulgated in 2006 by the Minister of Natural Resources and Environment promulgating the Regulations for establishing and printing topographic maps at scales of 1:250,000, 1:500,000, and 1:1,000,000 will expire from the effective date of Circular 11/2023/TT-BTNMT.

What are technical regulations?

According to Clause 2, Article 3 of the Law on standards and technical regulations 2006, technical regulation means regulation on the limits of technical characteristics and management requirements which products, goods, services, processes, the environment and other objects in socio-economic activities must comply with in order to ensure safety, hygiene and human health; to protect animals, plants and the environment; to safeguard national interests and security, consumer interests and other essential requirements.

A technical regulation shall be promulgated in a written form by a competent state agency for mandatory application.

Responsibilities for formulating, evaluating and promulgating technical regulations in Vietnam

Specifically, Article 27 of the Law on standards and technical regulations 2006 stipulates the responsibility for developing, appraising and promulgating technical regulations as follows:

(1) Responsibilities for formulating, evaluating and promulgating national technical regulations are as follows:

- Ministers and heads of ministerial-level agencies shall formulate and promulgate national technical regulations within the scope of branches or domains under their assigned management;

- The Minister of Science and Technology shall organize evaluation of draft national technical regulations;

- The Government shall stipulate the formulation, evaluation and promulgation of national technical regulations of inter-branch nature and national technical regulations for objects of activities in the domain of technical regulation falling under the management of government-attached agencies.

(2) Responsibilities for formulating, evaluating and promulgating local technical regulations are as follows:

- People's Committees of provinces or centrally run cities shall formulate and promulgate local technical regulations for application within the scope of local management to specific products, goods, services and processes of each locality and in response to specific environmental requirements suitable to local geographical, climatic, hydrological characteristics and socio-economic development levels;

- Local technical regulations shall be promulgated after they are approved by competent state agencies defined at Point a, Clause 1 of Article 27 of the Law on standards and technical regulations 2006.
