Regarding this issue, LawNet would like to answer as follows:

On January 5, 2024, the Government issued Resolution 02/NQ-CP on the main tasks and solutions to improve the business environment and enhance national competitiveness in 2024.

To improve the quality of the reform of the list of conditional investment and business sectors in Vietnam

Specifically, in improving the quality of the reform of the list of conditional business investment industries and business conditions, the Government has proposed the following key tasks and solutions:

(1) Ministries and central agencies:

- Proactively research and review conditional investment and business sectors in the field of management; propose to remove from the list of conditional business investment industries those industries that can apply other more effective management measures. If it is necessary to propose additional conditional business lines, a comprehensive impact assessment report is required. Completion in September 2024.

- Proactively review and recommend abolishing business conditions towards: (i) Abolish business conditions that are illegal, unnecessary, unfeasible, unclear, difficult to determine, difficult to predict, and not based on a clear scientific basis; (ii) For business conditions that are not consistent with reality, it is recommended to abolish or amend them in the direction of simplifying, facilitating, reducing compliance costs, and not interfering too deeply in business operations; and (iii) review types of certificates and recommend abolishing unnecessary certificates and shortening types of certificates with duplicate content to avoid wasting social costs. Completion in December 2024.

- Timely updates of legal documents to the National Legal Documents Database to ensure consistency, uniformity, transparency, ease of search, ease of understanding, and accessibility of the legal system. Promote connection, sharing, and exploitation of information between the National Database of Legal Documents, Portal for consulting and looking up business regulations with national databases, specialized databases, and other related information systemsto create favorable conditions for people and businesses in the process of searching for and exploiting information related to investment and business activities.

Actively consult and interact with people, businesses, and subjects affected by regulations and legal documents through the consultation portal and look up business regulations; exploit data on the Portal to serve the work of appraisal, verification, review, and development of legal documents.

- Regularly review and update conditional business investment industries and business investment conditions within the scope, functions, tasks, and assigned powers; send them to the Ministry of Planning and Investment for posting on the National Business Registration Portal.

(2) The Ministry of Justice presides over and coordinates with ministries, branches, and localities to improve the effectiveness and efficiency of the work of developing and appraising legal documents.

(3) The Ministry of Public Security presides and coordinates with ministries, branches, and localities to urgently review shortcomings, limitations, difficulties, and problems in the process of implementing legal documents on fire prevention, fighting, and rescue, as well as other related legal documents, and proposing, amending, and supplementing legal documents.

Coordinate with relevant ministries and agencies to amend relevant technical regulations or technical standards in accordance with actual conditions, appropriate to the location, geography, or specific characteristics of the project, construction, or vehicle. Completion in March 2024.

(4) The Ministry of Transport presides and coordinates with ministries, branches, and localities:

- Research and propose amendments to legal documents to reduce the cost burden for businesses and remove shortcomings in business conditions in the road transport business by car and in the field of training and driving tests.

- Direct local agencies to implement solutions to ensure synchronous infrastructure and sufficient capacity to receive, filter, exploit, and use connection data from businesses, especially camera data from transport business cars. Completed in 2024.
