Regulations on making and assigning annual plans for the implementation of national target programs in Vietnam

According to Decree 38/2023/ND-CP amending Decree 27/2022/ND-CP, the formulation and assignment of annual national target program implementation plans in Vietnam are regulated as follows:

(1) The planning for the implementation of the annual national target program by ministries, central agencies, and local levels at all levels shall be carried out at the same time as the socio-economic development planning,
public investment plans and annual state budget estimates.

(2) Contents of planning at local levels

- Evaluation of the results of the implementation of the national target program in the year of implementation, the possibility of completion, and the plan's objectives for the 5-year period.

- Anticipating the next year's goals, tasks, and plans according to each content and component project.

- Expected funding sources for implementation of national target programs, including: State budget capital is detailed according to the structure of investment expenditures, recurrent expenditures, and capital sources (including, capital proposed for support from the superior budget and self-balancing capital of the implementing-level budget); capital integrated from other local programs and projects (if any); credit capital (if any); and other lawfully mobilized capital (if any). Particularly for provincial planning, it is necessary to clarify the level of reciprocal capital from the local budget according to the regulations of each national target program.

- Estimated capital level for implementation of each component, activity, and component project; investment project list (according to local regulations on decentralization).

- Management solutions and implementation organization.

(3) Contents of plans of ministries and central agencies

- Evaluate the results of the implementation of the national target program in the year of implementation.

- Contents, tasks, activities, planned capital level, capital structure according to each planned activity next year; investment project list (if any).

- Implementation organization solution.

(4) Pursuant to this order, the making of plans for the implementation of annual national target programs by ministries, central agencies, and localities shall comply with the Directive of the Prime Minister, guidelines of the Ministry of Planning and Investment and the Ministry of Finance.

For planning the implementation of contents and activities under the national target program with the participation of people in the commune-level area, the provisions of Article 8 of Decree 27/2022/ND-CP

(5) Assigning an annual national target program implementation plan

- The Prime Minister assigns ministries, central agencies, and People's Committees of provinces and centrally-run cities with targets, tasks, capital investment plans, and central budget estimates for the next year of each national target program in accordance with the Law on Public Investment and the Law on State Budget.

- Ministries, central agencies, and People's Committees at all levels in their localities complete the assignment of objectives and tasks; State budget estimates, detailed annual capital investment plans according to the component projects of each program, and the list of investment projects to implement the national target program for agencies, units, and levels under the provisions of the Law on Public Investment and the Law on State Budget.

For the formulation, approval, and assignment of the list of public investment projects to implement the national target program in their localities, the regulations on decentralization of the provincial People's Councils must be complied with.
