To finalize the draft Decree amending Decree 118/2014/ND-CP on the arrangement and renewal of agricultural and forestry companies in Vietnam

The content mentioned in Notice 281/TB-VPCP in 2023 on the conclusion of Deputy Prime Minister Le Minh Khai at the meeting on amending Decree 118/2014/ND-CP on continuing to reorganize, innovate, and develop to improve the operational efficiency of agriculture and forestry companies issued by the Government Office of Vietnam.

The Deputy Prime Minister of Vietnam - Le Minh Khai concluded as follows:

**The Ministry of Agriculture and Rural Development has implemented the Politburo's policy at Conclusion 82-KL/TW dated July 29, 2020 and the Prime Minister's Plan at Decision 984/QD-TTg dated June 23, 2021, and submitted a draft Decree amending Decree 118/2014/ND-CP, but progress is still slow compared to the requirements, affecting the guidelines of the Prime Minister and the Prime Minister.

The Ministry of Agriculture and Rural Development is the agency in charge of formulating the Decree but does not send its leaders to the meeting or report to the Deputy Prime Minister.

Requesting the Ministry of Agriculture and Rural Development to seriously learn from experience and strictly comply with the Government's working regulations on the responsibilities of the agency in charge of elaborating legal documents; appointing leaders to attend all meetings chaired by the Government's leaders according to regulations; focusing on directing, and expeditiously completing the draft Decree to submit to the Government.

**The drafting of the above-mentioned draft Decree is difficult due to the authority to handle a number of contents to institutionalize the Politburo's policy on reorganizing, renovating, and improving the performance of agricultural and forestry companies beyond the Government's authority; related to many localities and areas, agricultural and forestry companies still face many difficulties in finance, security, and order. 

Request the Ministry of Finance and relevant ministries and agencies to closely coordinate with the Ministry of Agriculture and Rural Development, clarify relevant issues and contents under their management, and ensure compliance with the law and the Politburo's policy in Resolution 30-NQ/TW and Conclusion 82-KL/TW.

**The Ministry of Agriculture and Rural Development shall assume the prime responsibility for, and coordinate with the Ministry of Finance, the Ministry of Justice, and relevant ministries and agencies in, fully absorbing the opinions of the agencies attending the meeting, expeditiously finalizing the draft Decree amending Decree 118/2014/ND-CP to fully implement Conclusion 82-KL/TW of the Politburo, and submit it to the Government in July 2023 in accordance with the law; of which it should be noted:

- Prescribing specific contents under the Government's authority on continuing to arrange, innovate, and develop to improve the operational efficiency of agriculture and forestry companies;

- Regulations on responsibilities and tasks of each relevant ministry and branch according to their functions and tasks to summarize, propose, and report to competent authorities for promulgation for contents beyond the Government's authority and within the competence of the National Assembly to have a basis to implement the policy of the Politburo in Resolution 30-NQ/TW, Conclusion 82-KL/TW, and Decision 984/QD-TTg of the Prime Minister;

- For the content of financial mechanisms serving the arrangement, renewal, and improvement of the efficiency of agro-forestry activities (mechanisms and policies, state budget support, etc.), it is necessary to closely coordinate with the Ministry of Finance, the State Bank of Vietnam, and relevant agencies to research, evaluate specifically, propose handling mechanisms, ensure feasibility, publicity, transparency, fairness, rigor, and efficiency, do not cause loss of state assets, and do not allow policy abuse and corruption.
