Regarding this issue, LawNet would like to answer as follows:

On August 27, 2023, the Prime Minister issued Decision 998/QD-TTg on extending the pilot period of operation of the Food Safety Management Board of Da Nang city.

To extend the pilot period of the Food Safety Management Board of Da Nang, Vietnam 

Specifically, extending the operation period of the Food Safety Management Board of Da Nang City, which was piloted under Decision 1268/QD-TTg in 2017 and continued to operate under Decision 1319/QD-TTg 2020, from August 26, 2023 until there is a decision of the competent authority on the official organizational model of food safety management in Da Nang city.

The People's Committee of Da Nang City is responsible for evaluating the results of the pilot implementation of the Da Nang City Food Safety Management Board and coordinating with ministries and branches in the process of researching and amending relevant legal regulations.

Decision 998/QD-TTg takes effect from the date of signing.

Organizational structure of the Da Nang Food Safety Management Board

According to Article 3 of Decision 1268/QD-TTg 2017, the organizational structure of the Food Safety Management Board of Da Nang City is as follows:

- Leadership of the Management Board: The Management Board has a Head and no more than 03 Deputy Heads.

- The organizational structure of the Management Board includes:

+ There are 03 specialized departments; A specialized department has a Head of Department, no more than 02 Deputy Heads of Department and civil servants.

+ There are 05 professional teams; The professional team has a Captain, no more than 02 Deputy Captains and civil servants.

+ Affiliated public service unit: Food Testing Center.

- Payroll: The Management Board's payroll includes the payroll of civil servants and the number of people working in public non-business units by the People's Committee of Da Nang city, which is self-balanced in the total payroll of civil servants. The number of people working in agencies, administrative organizations, and non-business units of Da Nang city is assigned by competent authorities. Ensure no increase in staffing.

- The organizational structure of the Management Board is specifically stipulated by the People's Committee of Da Nang city.

Duties and powers of the People’s Committee of Da Nang, Vietnam

Because Da Nang city is a centrally run city, the People's Committee of Da Nang city will have the following duties and powers:

- Carry out the duties and powers stipulated in Article 21 of the Law on Organization of Local Government 2015.

- Formulate and request the municipal People’s Council to decide as well as organize the implementation of Clause 2, 3,4 and 5 Article 40 of the Law on Organization of Local Government 2015.

- Implement the plan and measure to create financial sources and mobilize funds for urban development purpose; consistently construct and manage urban infrastructural system as stipulated by laws.

- Decide on the incentive policies on urban facility development throughout the centrally-governed city.
