To ensure transparency and openness in anti-corruption inspection in Vietnam

Recently, the Government Inspectorate of Vietnam issued Circular 05/2011/TT-TTCP stipulating regulations on anti-corruption in the inspection sector.

According to Article 6 of Circular 05/2011/TT-TTCP, publicity and transparency in inspections in Vietnam are carried out as follows:

- Publicize on mass media and electronic information pages the legal regulations on inspection, annual inspection programs, and plans that have been approved immediately after the competent authority signs and approves them; except where otherwise provided by law.

- Notify in writing to the inspected entities, relevant agencies, and organizations, or publicize on mass media the assignment of inspection tasks, decisions to assign independent specialized inspectors, decisions to assign supervisors of the inspection team, inspection decisions, inspection conclusions, post-inspection handling decisions, and inspection supervision reports immediately after the competent authority signs and approves them; except where otherwise provided by law in Vietnam.

- The plan to conduct inspections, tasks assigned to the members of the Inspection team, progress reports, inspection result reports, and other directive, supplementary, or replacement documents must be made public within the Inspection team and to those assigned to supervise the Inspection team.

Three requirements for anti-corruption inspections in Vietnam:

- The annual inspection plan must be based on the requirements and tasks of the state management agency at the same level; guidance from the superior inspection agency; clearly defining the purpose, requirements, content, scope, target, time of implementation, and ensuring feasibility.

- Inspection must be carried out with proper authority, following procedures, publicly, transparently, democratically; inspection conclusions, recommendations, and handling decisions must be accurate, objective, truthful, and promptly delivered according to the law; when concluding there are violations, it must be determined whether there are signs of corruption.

- The checking and urging the implementation of recommendations, and post-inspection handling decisions must be public, objective, and truthful, contributing to ensuring the effectiveness of the recommendations and post-inspection handling decisions.

More details can be found in Circular 05/2011/TT-TTCP, which comes into force in Vietnam from March 7, 2011.
