How are the consideration and posthumous award of the "Glorious Youth Volunteer Medal" guided in Vietnam?

The Ministry of Industry and Trade issued Official Dispatch 7498/BCT-TCCB in 2023, commenting on the draft Circular stipulating measures to implement the Decree detailing the order and procedures for considering and posthumously awarding the "Glorious Youth Volunteer Medal".
Response to the official dispatch of the Central Emulation and Commendation Committee on collecting comments on the draft Circular stipulating measures to implement the Decree detailing the order and procedures for considering and posthumously awarding the "Glorious Youth Volunteer Medal", the Ministry of Industry and Trade has the following opinions:
- Proposal to supplement the scope of regulation and subjects of application in the draft Circular.
- Draft Circular guiding the Decree detailing the order and procedures for considering and posthumously awarding the "Glorious Youth Volunteer Medal". Therefore, the guiding contents of the draft Circular need to ensure compliance with the contents of the Decree.
The Ministry of Industry and Trade found that the draft Circular has added a number of documents in addition to the dossier for considering and posthumously awarding the "Glorious Youth Volunteer Medal" specified in the draft Decree. Therefore, it is recommended that the Agency in charge conduct research and review to avoid arising documents outside the provisions of the Decree.
In addition, the draft Circular stipulates rewards for achievements in the resistance war against the US, but does not stipulate rewards for achievements in the resistance war against France during the period of defending the Fatherland. Therefore, it is recommended that the Drafting Agency conduct additional research to ensure full guidance on the contents of the draft Decree.
- Regarding implementation effect: This Circular guides the Decree detailing the order and procedures for considering and posthumously awarding the "Glorious Youth Volunteer Medal". In the event that the decree is not promulgated before November 15, 2023, to serve as a legal basis for promulgating the Circular, the drafting agency is requested to note the effective date of the Circular to comply with the provisions of Article 151 of the Law on Promulgation of Legislative Documents, the effective date of the Circular must be no earlier than 45 days from the date of signing.
According to Article 96 of the Law on Emulation and Commendation 2022, it is mentioned that the summary rewards for resistance achievements are as follows:
From the effective date of the Law on Emulation and Commendation 2022 which takes effect (January 1, 2024), the summary and commendation for revolutionary achievements shall be carried out as follows:
- The State shall continue to consider, perform, and complete the commendation for revolutionary achievements in the resistance and Fatherland Defense for eligible and qualified individuals, collectives, and households;
- The State shall award and posthumously award “Glorious Youth Volunteer Medals” to voluntary young adults who have achievements in the resistance and Fatherland Defense, complete tasks, stay loyal to the resistance, and have served in the Army for at least 2 years. Voluntary young adults who sacrificed themselves while on duty in the resistance and Fatherland Defense recognized as martyrs shall be posthumously awarded “Glorious Youth Volunteer Medals”;
- The Government of Vietnam shall elaborate on the procedures for awarding and posthumously awarding the ““Glorious Youth Volunteer Medal”; provide guidelines on the implementation.
