On June 28, 2024, the Ministry of Health issued Official Dispatch 3619/BYT-KCB on conducting medical assessments for recognizing and settling preferential policies for people with meritorious services to the revolution and relatives in Vietnam
Following Decree 131/2021/ND-CP dated December 30, 2021, from the Government detailing and implementing the Ordinance on Preferential Policies for Revolutionaries, the Ministry of Health requests that relevant units carry out medical assessments to establish the basis for recognizing and resolving preferential policies for revolutionaries and their families as per the guidelines outlined in Decree 131/2021/ND-CP and accompanying implementing documents. To be specific:
Medical assessments to determine injuries or diseases for injured individuals, war invalids, class B war invalids, individuals entitled to war invalids' policies, war participants, the relatives of revolutionaries, and determination of diseases, deformities, and disabilities related to chemical exposure for resistance activists and their biological children shall be conducted as per the provisions of Decree 131/2021/ND-CP.
Documents, diagnoses, and medical assessments of diseases, deformities, and disabilities related to chemical exposure shall follow these regulations:
Medical assessment documents
++ Summary medical record, Surgery certificate according to Form 2 and Form 52 in Appendix XXIX issued with Circular 32/2023/TT-BYT.
++ Discharge certificate per Appendix 3 issued with Circular 18/2022/TT-BYT.
Diagnosis of diseases, deformities, and disabilities related to chemical exposure follows the guidelines in Decision 3201/QD-BYT dated June 29, 2016, from the Ministry of Health approving the professional document "Guideline for Diagnosing Diseases, Deformities, and Disabilities Related to Chemical/Dioxin Exposure".
Medical assessment of diseases, deformities, and disabilities related to chemical exposure follow the guidelines in Decision 4779/QD-BYT dated December 30, 2023, from the Ministry of Health approving the guideline document for assessing diseases, deformities, and disabilities related to chemical/dioxin exposure based on the document issued with Decision 3201/QD-BYT dated June 29, 2016, from the Ministry of Health.
The method for synthesizing the percentage of body impairment follows the regulations in Article 168 of Decree 131/2021/ND-CP dated December 30, 2021, from the Government detailing and implementing the Ordinance on Preferential Policies for Revolutionaries and Joint Circular 28/2013/TTLT-BYT-BLDTBXH dated September 27, 2013, from the Ministry of Health and the Ministry of Labor, War Invalids and Social Affairs, stipulating the percentage of body impairment due to injuries, diseases, and occupational diseases.
According to Article 3 of the 2020 Ordinance on Preferential Treatment for Revolutionaries, the following individuals are entitled to preferential treatment for revolutionaries: - Individuals who participated in revolutionary activities before January 1, 1945; |
