Regarding this issue, LawNet would like to answer as follows:

The Minister of Science and Technology issued Circular 18/2023/TT-BKHCN dated August 15, 2023, amending a number of articles of the Ta Quang Buu Award Regulations issued together with Circular 01/2015/TT-BKHCN.

To amend the criteria for scientists to be considered for the Ta Quang Buu Award in Vietnam

Specifically, from October 1, 2023, the standards for scientists to be considered for the Ta Quang Buu Award are prescribed as follows:

(1) Be nominated by an organization or individual and submit a dossier for consideration of awarding the Award according to the provisions of Article 8 of the Regulations issued with Circular 01/2015/TT-BKHCN (amended in Circular 18/2023/TT-BKHCN).

(2) Have basic research results that meet the following standards:

- Made in Vietnam;

- Published in international scientific journals for at least one (01) year and no more than seven (07) years from the end of receiving applications for the Award;

- Register and store the results of performing scientific and technological tasks according to the provisions of the law in case it is the result of a scientific and technological task that uses or receives financial support from the state budget;

(3) Make the most important contribution to the basic research results mentioned in (2).

(4) Do not violate the provisions of Article 8 of the Law on Science and Technology 2013, specifically:

- Taking advantage of scientific and technological activities to violate the interests of the State, the legitimate rights and interests of organizations and individuals; causing damage to natural resources, the environment, and human health; contrary to the morality and fine customs of the nation.

- Infringement of intellectual property rights; illegally appropriating, assigning, and transferring scientific and technological results.

- Disclosing scientific and technological documents and results listed as state secrets; deception and falsification in scientific and technological activities.

- Obstructing legal scientific and technological activities of organizations and individuals.

According to Article 7 of the Promulgation Regulations attached to Circular 01/2015/TT-BKHCN, authors considered for the Ta Quang Buu Prize must meet the following standards:

- Be nominated by an organization or individual or self-nominate and submit a dossier requesting consideration for awarding the Award according to the provisions of Article 9 of the Promulgation Regulations attached to Circular 01/2015/TT-BKHCN.

- Have a scientific work considered for award that meets the following standards:

+ Made in Vietnam;

+ Published at least one (01) year in advance and no more than five (05) years in advance in international scientific journals by the end of receiving applications for the Award (calculated according to the publication date of the magazine);

+ Be registered to store the results of performing scientific and technological tasks according to the provisions of law in case the scientific work is the result of scientific and technological tasks that use or receive financial support from the state budget;

+ Do not violate the regulations in Clause 3, Article 5 of Decree 78/2014/ND-CP on Ho Chi Minh Prize, State Prize and other awards in science and technology.

- Have the most important contribution to the scientific work considered for the Award.

- Do not violate the provisions of Article 8 of the Law on Science and Technology 2013.

2 additional fields that are considered for the Ta Quang Buu Award in Vietnam

The Ta Quang Buu Prize will be awarded to individuals engaged in basic research in the following fields:

- Natural sciences: mathematics, computer and information sciences, physics, chemistry, related earth and environmental sciences, biology, and other natural sciences;

- Science, engineering, and technology;

- Medical and pharmaceutical sciences;

- Agricultural science;

- Social science; (Additional compared to Circular 01/2015/TT-BKHCN)

- Humanities. (Additional compared to Circular 01/2015/TT-BKHCN)
