Regarding this issue, LawNet would like to answer as follows:

The Ministry of Transport of Vietnam promulgates Circular 2/2023/TT-BGTVT, which adjusts the inspection cycle for a number of motor vehicles as follows:

1. Adjusting the inspection cycle for certain types of motor vehicles in Vietnam

In Appendix V of Circular 2/2023/TT-BGTVT (replacing Appendix XI of Circular 16/2021/TT-BGTVT) the inspection cycle for a number of motor vehicles is adjusted as follows:

(1) For passenger automobiles with more than 9 seats not doing transport business:

- The first cycle is exempt from inspection and increases from 30 months to 36 months;

- Production time up to 07 years: inspection cycle increased from 18 months to 24 months;

- Production time over 07 years to 20 years (previously over 07 years to 12 years): the inspection cycle remains 12 months;

- Production time over 20 years (previously over 12 years): the inspection cycle remains the same 6 months.

(2) For passenger automobiles with more than 9 seats:

- The first cycle is exempt from inspection and increases from 18 months to 24 months;

- Production time up to 5 years: inspection cycle increased from 6 months to 12 months;

- Production time over 5 years: the inspection cycle remains the same 6 months.

(3) Group of trucks of all kinds, tractors with a production period of 20 years or more (including trucks and tractors that have been converted into special-use cars); Trucks that have been renovated and converted from passenger cars for 15 years or more: may extend the inspection cycle from 3 months to 6 months.

In addition, for passenger automobiles with up to 09 seats with transport business, trucks of all kinds, special-use cars, tractors, trailers, semi-trailers, and passenger automobiles with more than 9 seats manufactured for 15 years or more (including passenger automobiles with more than 9 seats that have been converted into passenger automobiles with up to 09 seats), the inspection cycle remains the same.

Thus, compared with current regulations, the inspection cycle for some types of motor vehicles has been longer.

2. If the seal of inspection is lost or damaged, it is not mandatory to bring the vehicle to the registration unit in Vietnam

Clause 4, Article 1 of Circular 2/2023/TT-BGTVT stipulates that if the Certificate of Inspection or the seal of inspection is lost or damaged, the vehicle owner must take the vehicle for re-inspection in order to issue the Certificate of Inspection and Stamp of Inspection, except for the following cases:

- If the certificate of first certificate of inspection or the first seal of inspection of the motor vehicle exempted from inspection is lost, within 07 working days from the date of issuance of the first certificate of inspection or the first seal of inspection, the vehicle owner or the person authorized by law to the registration units to declare according to the form in Appendix I promulgated together with Circular 2/2023/TT-BGTVT to be reprinted only once, the Certificate of Inspection, the seal of inspection (the vehicle owner does not have to bring the vehicle to the registry);

- If the inspection certificate or the seal of inspection of the motor vehicle exempted from the first inspection is damaged, there is a deviation from the information of the vehicle, the vehicle owner brings the certificate of inspection, the seal of inspection has been issued to the registration unit and declares according to the form in Appendix I promulgated together with Circular 2/2023/TT-BGTVT for the registration unit to review and check information and to be reprinted the Certificate of Inspection, seal of inspection (The owner does not have to bring the car to the registration unit).

Previously, in Circular 16/2021/TT-BGTVT, in all cases where the Certificate of Inspection and seal of inspection was lost or damaged, the vehicle owner had to take the vehicle for re-inspection to issue the Certificate of Inspection, seal of inspection.

Circular 2/2023/TT-BGTVT takes effect from March 22, 2023.
