Regarding the Draft Law amending several articles of the Law on Health Insurance, the Government of Vietnam requires adherence to 04 major policies that have been approved.

On September 23, 2024, the Government of Vietnam convened to review and provide opinions on the following: the Law on Data Project, Proposal to formulate the Law on Personal Data Protection, the Law on Amendments and Supplements to a Number of Articles of the Law on Health Insurance Project, and the Proposal to formulate the Law on Lawyers (Amended).

Based on the discussions of the Government of Vietnam members and the conclusion of the Prime Minister of the Government of Vietnam at the Thematic Session on law-making (following the Government of Vietnam's Thematic Session on law-making on September 14, 2024), and pursuant to Resolution 174/NQ-CP dated October 2, 2024, after hearing reports and opinions from ministries and related agencies, the Government of Vietnam resolved the following:

The Government of Vietnam highly appreciates the Ministry of Health of Vietnam for promptly leading and coordinating with relevant ministries and central authorities to actively prepare and submit the Law Project dossier in accordance with the Law on Promulgation of Legal Normative Documents; agreeing on the necessity of promulgating the Law to institutionalize the Communist Party's directives, improve existing regulations, and contribute to fulfilling state management requirements and implementing health insurance.

Acknowledging practical issues, the current Law Project primarily focuses on amending and supplementing urgent contents to be consistent with the Law on Medical Examination and Treatment and the Law on Social Insurance; essentially adhering to the four major policies already approved by the Government of Vietnam, ensuring consistency with related laws; ensuring delegation, decentralization, reduction of administrative procedures, healthcare procedures, facilitating the public. The Ministry of Health of Vietnam is tasked with thoroughly studying and incorporating the opinions of the Government of Vietnam members, opinions of ministries, related agencies, and completing the requirements as follows:

- Regarding electronic health insurance cards: incorporate the Ministry of Justice's suggestion to define the implementation roadmap.

- On handling violations related to "late payment" of health insurance: a review and comprehensive amendment are required to align with the Law on Handling Administrative Violations and the Law on Social Insurance.

- Remove the clause concerning the Government of Vietnam's regulation on unresolved cases in payment for health insurance medical examination and treatment.

- Continue rigorously studying core issues leading to practical hindrances for health insurance beneficiaries, policies for health insurance managers, expanding or narrowing health insurance coverage, responsibilities for health insurance verification, and other significant issues raised by Deputy Prime Ministers (state budget support for medical facilities with substantial social insurance debt within the capability of various budget levels; tasking the Ministry of Health of Vietnam with issuing health insurance medical examination procedures and materials, medicines; ...).

Assign the Ministry of Health of Vietnam to lead, coordinate with the Ministry of Justice, Government Office, and relevant agencies to complete the Law Project dossier as per the regulations of the Law on Promulgation of Legal Normative Documents. Authorize the Minister of Health, on behalf of the Prime Minister of the Government of Vietnam, to sign and submit the Law Project to the National Assembly.
