Regarding this issue, LawNet would like to answer as follows:
According to Article 4 of Decree 72/2023/NĐ-CP, titles that are allowed to regularly use an automobile, even when retired from work with no specified price, including:
- General Secretary.
- President.
- Prime Minister; President of Congress.
Titles that allow you to regularly use an automobile during work without any price regulations include:
- Standing member of the Secretariat; Politburo Commissioner; Member of the Secretariat; Chairman of the Central Committee of the Vietnam Fatherland Front; Chief Justice of the Supreme People's Court; Director of the Supreme People's Procuracy; Vice President; Deputy Prime Minister; Congress vice president.
- Equipment mode:
+ In case of purchasing new automobiles, the Prime Minister decides on the type and purchase price of automobiles equipped for the positions specified above at the request of the Minister, Head of central agency, Relevant Provincial People's Committee.
+ In case of equipment in the form of delivery and transfer of automobiles, the agency or person with authority to deliver and transfer automobiles according to the provisions of the law on the management and use of public assets decides on the assignment and transfer of automobiles to equip the positions specified above. The order and procedures for delivering and moving automobiles comply with the provisions of the law on the management and use of public assets.
3. Subjects allowed to use and authority to decide the number of automobiles for general work in Vietnam
(i) automobiles for general business purposes are single-wheel drive or two-wheel drive automobiles, with seating capacity from 4 to 16 seats (including pickup trucks) to serve the general work of agencies, organizations, and units (including affiliated and subordinate units of agencies, organizations, and units), state-owned enterprises, not on the list of specialized automobiles specified in Article 16 of Decree 72/2023/NĐ-CP.
(ii) The following subjects are allowed to use automobiles for general work to automobilery out responsibilities and tasks assigned by agencies, organizations, units, and state-owned enterprises (not used to pick up or drop off from residence to office and vice versa):
- Deputy Director General and equivalent.
- Head of Department and equivalent; Deputy Director of Department and equivalent.
- Vice Chairman of the People's Council, Vice Chairman of the People's Committee of provinces and centrally run cities (except Hanoi and Ho Chi Minh City).
- Director, Deputy Director of the department and equivalent at the provincial level.
- Secretary of the District Party Committee, District Party Committee, City Party Committee, and Town Party Committee; Chairman of the District People's Council, Chairman of the District People's Committee.
- Member of the Standing Committee of the District Party Committee, District Party Committee, City Party Committee, and Town Party Committee; Chairman, District-level Vietnam Fatherland Front Committee; Vice Chairman of the District People's Council, Vice Chairman of the District People's Committee.
- Member (Member) of the Board of Members, Board of Directors, Deputy General Director of economic groups; Company President, Director, Deputy Director and equivalent positions at state-owned enterprises.
- Officials, civil servants, public employees, and workers assigned to perform specific tasks of agencies, organizations, and units; the list of specific tasks is specified in the Regulations on management and use of public assets of agencies, organizations, and units.
(iii) In case of necessity due to work requirements, heads of agencies, organizations, units, and state-owned enterprises make decisions for officials, civil servants, public employees, and workers aside from the subjects specified in Clause (ii), they are allowed to use automobiles for general business purposes to go on business trips.
(iv) The subjects specified in clauses (ii) and (iii) are allocated automobiles for general business purposes or are allocated funds to use automobiles or rent automobile services when going on business trips. The allocation of costs for using automobiles and renting automobile services shall comply with the provisions of Article 21 and Article 22 of Decree 72/2023/NĐ-CP.
(v) In addition to the number of automobiles determined according to the provisions of Articles 9, 10, 11, and 12 of Decree 72/2023/NĐ-CP, ministries, central agencies, and provincial People's Committees (after obtaining the unanimous opinion of the Provincial People's Council) shall consider and decide on the number of pickup trucks and automobiles with 12–16 seats to serve general work for agencies and units assigned to perform the tasks of forest rangers, forest fire prevention, disease prevention in agriculture, border patrol, sproviding people with meritorious services, social protection, demarcation, basic geological and mineral surveys, monitoring, and analysis of environmental samples under the management of ministries, central agencies, and localities to ensure savings and efficiency.
(vi) Based on the total number of automobiles serving general work determined according to the provisions of Article 9, Clause 1, Article 10, Article 11, Article 12, Point a, Clause 1, Article 14 and Clause 7, Article 3, Decree 72/2023/NĐ-CP:
- Ministers and Heads of central agencies decide on the number and type of automobiles of each agency, organization, unit under or under the ministry or central agency (except for vertical units under the general department located in provincial areas and public service units under the general department).
- Provincial People's Committee (after asking for opinions from relevant agencies according to the Working Regulations of the Provincial Party Committee and City Party Committee) shall decide the number and types of automobiles according to the standards and norms of each Provincial Office (Office of the Provincial Party Committee, Centrally-run City Party Committee, Office of the National Assembly Delegation and Provincial People's Council, Office of the Provincial People's Committee); departments, divisions, branches and equivalents at the provincial level, the Vietnam Fatherland Front at the provincial level, and socio-political organizations at the provincial level; public service units under the Provincial People's Committee; districts, towns, provincial cities, and centrally run cities.
- The Standing Committee of the Provincial Party Committee and City Party Committee decides on the number and types of automobiles according to the standards and norms of each agency and unit under the Provincial Party Committee and centrally run City Party Committee (except Provincial Party Committee Office, City Party Committee) and public service units under the Provincial Party Committee, City Party Committee.
- The decision on the number of automobiles specified above does not apply to agencies, organizations and units equipped with automobiles as prescribed in Clause (v).
