This is a noteworthy provision stipulated in Circular 192/2016/TT-BQP regulating the application of disciplinary forms, sequence, procedures, statute of limitations, time limits, and authority for handling disciplinary actions in the Ministry of National Defense.
In accordance with the principles of the Ministry of Defense's disciplinary actions, female soldiers, workers, and public defense employees shall not be stripped of military titles or dismissed while pregnant, on maternity leave, or raising children under 12 months old.
Additionally, the handling of disciplinary actions must ensure the following principles:
- Any acts of physical assault, disparagement of honor, or dignity violations during the disciplinary review process are strictly prohibited.- Demotion of military rank shall not be applied to professional soldiers holding the rank of second lieutenant; salary grade demotion shall not be applied to professional soldiers, workers, and public defense employees currently receiving salary grade 1.- When handling disciplinary actions, apart from specific disciplinary measures for individual violations, if the violation causes material damage, the violator must also provide compensation.- Each legal violation shall result in only one form of disciplinary action. If a single disciplinary violation involves multiple acts of misconduct, only one comprehensive disciplinary measure shall be applied, not exceeding the punishment level of the most severe violation.- ...
