The Gregorian New Year’s holiday of 2017 is approaching, many workers are wondering how many days the New Year’s holiday lasts in order to prepare train tickets, buses, airplanes to go back to their hometowns or plan for travel... Therefore, how does the law regulate this issue?
Based on the provisions at Article 115 of the 2012 Labor Code, employees are entitled to leave with full pay on the occasion of the New Year holiday, January 1, 2017. If the New Year holiday coincides with a weekly day off, employees are entitled to an additional day off on the following day.
The New Year holiday on January 1, 2017 falls on a Sunday, so employees will be entitled to a compensatory day off on Monday, January 2, 2017.
Accordingly, the New Year holiday schedule for 2017 is as follows:
- Officials and public employees, and employees working at establishments with a two-day-per-week leave policy will have 3 consecutive days off from Saturday, December 31, 2016, to the end of Monday, January 2, 2017;- Employees working at establishments with a one-day-per-week leave policy will have 2 consecutive days off from Sunday, January 1, 2017, to the end of Monday, January 2, 2017.
Regarding salary policies
- Employees will have leave and receive full pay on January 1, 2017;- In case employees work on January 1, 2017, their salary will be at least 300% excluding the holiday pay for those who receive daily wages (the total salary will be 400% of the normal daily wage - point c clause 1 Article 97 of the 2012 Labor Code).
