Title: 05 Principles for the Use of Standard Working Hours

This is an important content stipulated by the Ministry of Labor, War Invalids and Social Affairs in Circular 54/2015/TT-BLDTBXH guiding working hours and rest periods for employees engaged in seasonal production work and processing goods according to orders, issued on December 16, 2015.

Circular 54/2015/TT-BLDTBXH stipulates the use of standard working hours fund which must comply with the following principles:

- Within a year, the total standard working hours planned under Circular 54 (including rest time during the day counted as working hours) must not exceed the annual standard working hours fund (TQ).- The daily standard working hours are less than 8 hours, or less than 6 hours for workers engaged in particularly heavy, hazardous, or dangerous jobs, if planned following the guidelines, the employer is not required to pay idle time wages to the employee.- If the planned daily standard working hours are not allocated to the worker in reality, the employer must pay idle time wages to the worker.- If the planned daily standard working hours exceed 8 hours, or exceed 6 hours for workers engaged in particularly heavy, hazardous, or dangerous jobs, the surplus hours are not counted as overtime.- ...
