On July 24, 2024, the Government of Vietnam issued Decree 94/2024/ND-CP detailing several articles of the Law on Real Estate Business 2023 regarding the construction and management of information systems, databases on housing, and the real estate market.

Time of disclosure of information about housing and real estate market in Vietnam from August 1, 2024

According to Article 20 of Decree 94/2024/ND-CP regulating the disclosure of information about housing and the real estate market in Vietnam as follows:

Summary information about housing and the real estate market is disclosed on the information portal of the housing and real estate market information system at the website address https://batdongsan.xaydung.gov.vn.

(1) The Ministry of Construction of Vietnam periodically discloses summarized information about housing and the real estate market nationwide:

- Annually: Before February 10 of the year following the year of announcing data on the results of the development of various types of housing nationwide compiled from the housing data of localities as stipulated in Clause 2, Article 6 of this Decree.

- Quarterly: Before the 25th of the first month of the quarter following the quarter announcing the following information:

+ Information and data on the situation of granting Certificates of Land Use Rights and Ownership of Assets Attached to Land summarized from Template No. 2.

+ Information and data on the structure of real estate products; real estate eligible for transactions; transfer of real estate projects; quantity and transaction value; real estate inventory of real estate projects nationwide compiled from local real estate market data stipulated in Clause 2, Article 8 of this Decree.

+ Information and data on the real estate market including:

++  On  foreign  direct  investment  in  the  real  estate  business  sector  compiled  from  Form No.  5;

++  On  credit  balance  for  business  activities  in  the  real  estate  sector  compiled  from  Form No.  6;

++  On  corporate  bond  issuance  related  to  the  real  estate  business  sector  compiled  from  Form No.  7;

++  On  taxes  related  to  real  estate  transfer  activities  compiled  from  Form No.  8;

++  On  the  quantity  and  value  of  real  estate  transactions  through  notarization  and  certification  activities  compiled  from  local  real  estate  market  data.

+ Information and data on real estate service business organizations nationwide compiled from local real estate market data stipulated in Clause 4, Article 8 of this Decree.

(2) Provincial People's Committees, centrally-run cities periodically disclose summarized information about housing and the real estate market in the local area:

- Annually: Before January 31 of the year following the year of announcing the following information:

+ Information and data on individuals who have bought, rented, or rented to buy social housing in the area summarized from Template No. 19.

+ Information and data on foreign organizations and individuals owning housing in Vietnam in the area summarized from Template No. 20.

- Quarterly: Before the 20th of the first month of the quarter following the quarter announcing the following information:

+ Information and data on the structure of real estate products; real estate eligible for transactions; transfer of real estate projects; quantity and transaction value; real estate inventory of real estate projects in the area as stipulated in Article 9 compiled from Template No. 9, Template No. 10, Template No. 11 of the Appendix attached to this Decree.

+ Information and data on the real estate market, including:

++  On  foreign  direct  investment  in  the  real  estate  business  sector  in  the  area  summarized  from  Form No.  12;

++  On  investment  certificate  issuance  for  various  types  of  real  estate  projects  in  the  area  summarized  from  Form No.  13;

++  On  the  quantity  and  value  of  real  estate  transactions  through  notarization  and  certification  activities  in  the  area  compiled  from  Form No.  14;

++  On  homestead  land  for  auction  and  the  auction  situation  of  homestead  land  for  public  investment  infrastructure  construction  projects  for  housing  development  auctions  for  individuals  to  build  their  own  houses  compiled  from  Form No.  15.

+ Information and data on real estate service business organizations registered to operate in the area compiled from Template No. 16, including:

++  Information  on  real  estate  trading  floor  service  business  organizations;

++  Information  on  real  estate  brokerage  service  business  organizations;

++  Information  on  real  estate  consultancy  service,  management  business  organizations.
