Below is the content of the regulation on the time limit for deciding on official recruitment and employment in Vietnam according to Decree 116/2024/ND-CP.

Time limit for deciding on official recruitment and employment under the latest regulations in Vietnam

According to Clause 10, Article 1 of Decree 116/2024/ND-CP, which amends Article 17 of Decree 138/2020/ND-CP, it is stipulated:

(1) No later than 5 working days from the expiration date for completing recruitment documents as stipulated in Clause 1, Article 16 of Decree 138/2020/ND-CP, the head of the authority with recruitment authority must issue a recruitment decision and notify the successful candidate. The authority with recruitment authority is responsible for requesting the competent authority under the law on judicial records to issue the judicial record certificate of the successful candidate.

(2) No later than 30 days from the issuance date of the recruitment decision, the recruited person must start work unless the recruitment decision specifies a different timeframe or the recruitment authority approves an extension.

(3) If the recruited person does not report to work within the timeframe specified in (2), or if the judicial record certificate indicates conditions that disqualify the person from registering as an official, the head of the recruitment authority will revoke the recruitment decision.

(4) After the expiration of the timeframe specified in (2), the recruiting authority will publicly announce it on their website or portal and notify the candidates with the next lowest recruitment results (in order) compared to the successful candidate whose recruitment result has been revoked as per Clause 2, Article 16 of Decree 138/2020/ND-CP or whose recruitment decision has been canceled according to Clause 3 of this Article, allowing them to complete documents and issue recruitment decisions no later than 15 days from the expiration of the timeframe specified in (2).

If there are 2 or more candidates with equal next lowest recruitment results, the head of the recruitment authority will decide on the successful candidate following the regulations in Clause 2, Article 9 of Decree 138/2020/ND-CP (in case of a recruitment examination) or specified in Clause 2, Article 12 of the same decree (in case of an evaluation selection).

Latest regulations on determining successful candidates of the official recruitment examination

In Clause 5, Article 1 of Decree 116/2024/ND-CP, an amendment to Article 8 of Decree 138/2020/ND-CP stipulates the criteria for determining successful candidates in the official recruitment examination in Vietnam as follows:

- Successful candidates in the official recruitment examination must meet the following conditions:

+ Achieve a score of 50 or higher in the second round. In cases where the exam includes both written and oral components, the candidate must complete both parts and achieve at least 50% of the maximum score for each.

+ The combined score of the second round along with any priority points (if applicable) should be higher, in descending order of score, within the recruitment quota for each job position, including positions recruited jointly for multiple official-utilizing agencies.

- In the event that two or more candidates have the same total score as stipulated in point b, Clause 1, Article 8 of Decree 138/2020/ND-CP, as revised by Clause 5, Article 1 of Decree 116/2024/ND-CP, a priority order is applied in determining the successful candidate:

+ The candidate with a higher score in the second round.

+ The candidate with a higher score in the written component of the second round for combined written and interview selections.

+ A candidate who passed the quality assurance assessment and was exempt from the first round.

+ A candidate with a higher quality assurance assessment score if both were exempt from the first round.

+ A candidate with more correct answers in the general knowledge subject of the first round if both participated in this round.

If a decision still cannot be reached according to the priority order, the head of the recruiting authority will decide on the successful candidate.

- For job positions recruited jointly for multiple official-utilizing agencies, the determination of the successful candidate in government service is based on the order of preference indicated in the candidate's application form.

If more candidates successfully pass for a government service agency than there are open positions, priority is given to those with higher recruitment outcomes.

If two or more candidates have equal recruitment outcomes for the final available government service position, the decision will follow the priority order stipulated in Clause 2, Article 8 of Decree 138/2020/ND-CP as amended by Clause 5, Article 1 of Decree 116/2024/ND-CP.

- Candidates who do not succeed in the official recruitment examination cannot carry their recruitment exam results to subsequent recruitment cycles.
