Three Forms of Border Defense Foreign Affairs Activities according to Decree No. 89/2009/ND-CP

Recently, at the request of the Minister of Defense, the Government of Vietnam issued Decree 89/2009/ND-CP regulating border defense foreign relations activities.

The types of border defense foreign affairs are specifically stipulated in Article 7 of Decree 89/2009/ND-CP, which regulates the activities of border defense foreign affairs as follows:

Firstly, Direct Contact Relations through Negotiations:

- Meetings and negotiations are conducted in the following cases:- Negotiations for the implementation of international treaties on national borders;- Periodic or occasional exchanges and negotiations to coordinate the resolution of incidents occurring on the border or incidents related to border management and protection, maintaining security and order in border areas and border gates.- Working meetings on the border or at a suitable location for regular or occasional exchanges; coordinating the implementation of content specified in the Border Regulation Agreement or resolving incidents occurring in border areas and border gates.- Coordinating bilateral patrols to check the border line and national landmarks as planned or on an ad-hoc basis. Handing over and receiving people, exhibits, and means violating the Border Regulation Agreement;- The handing over and receiving of violating persons is carried out at the border gates or other locations on the border line as agreed by both parties;- Invitation letters are carried out in the following cases:- Inviting the counterpart or being invited to work to exchange situations, resolve incidents related to border management and protection, maintaining security and order in border areas and border gates according to the division of power or the direction of the Prime Minister of the Government of Vietnam.- Inviting the counterpart or being invited for a courtesy visit on the occasion of holidays, New Year, traditional days, and other activities.

Secondly, Indirect Contact Relations:

- Notification or exchange letters are carried out in the following cases:- Situations related to the national border management and protection; the status of the border line, national landmarks, the implementation of the Border Regulation Agreement, and relevant international treaties on borders; the content of working and negotiating sessions of specialized sectors at local levels according to the agreed plan;- Notifying the neighboring country of accidents or deaths where the victims are from the neighboring country; notifying the handover of illegal border crossers, subjects detained by us who need to be handed over or notifying the subjects we are searching for to coordinate search, arrest;- Situations of natural disasters, pandemics occurring in border areas;- Notifying other contents as directed by the direct superior agency;- Notification letters are carried out periodically or ad-hoc via communication means or liaison officers, depending on the nature and extent of the incident for appropriate action.- Protest letters are carried out when the neighboring country engages in activities such as:- Violating territorial sovereignty, border security on land, at sea, in the air, and underground; shifting and damaging national landmarks, distorting and redirecting the national border line; changing the natural flow of border rivers and streams; unlawful cultivation, residence in border areas, building constructions affecting the legal position of the border line and contrary to the Border Regulation Agreement;- Concealing and aiding criminals, illegally trading and transporting weapons, explosives, hazardous substances, drugs, smuggling, human trafficking across the border, money laundering, terrorist activities, pushing people across the border.- Spreading propaganda distorting the policies of the Communist Party and the laws of the State of Vietnam; provoking divisions in friendly relations with Vietnam; undermining peace, stability in border areas with Vietnam;- Other activities violating the Border Regulation Agreement.

Thirdly, Diplomatic Contact Relations:

- Organizing delegations for courtesy visits or welcoming neighboring functional forces during holidays, New Year, traditional days of both sides; visiting and extending condolences during national mourning, natural disasters, fires, or participating in other activities.
