Three Conditions for Appointment of Intermediate-Level Police Officers of the Coast Guard

This is a notable provision in Circular 177/2019/TT-BQP issued by the Minister of National Defense, which stipulates the standards, conditions, order, procedures for appointment, dismissal, and removal, as well as the certification form for Police Officers and Reconnaissance Officers of the Vietnam Coast Guard.

Persons who meet the criteria specified in Article 7 of Circular 177/2019/TT-BQP and have the following conditions can be appointed as Intermediate Police Officers:

- Have been a Junior Police Officer for at least 05 (five) years;- Have the capability to handle administrative violations according to the law on handling administrative violations; collect, analyze, evaluate, forecast, and advise on campaign-level handling of the situation related to security, safety, maritime sovereignty, criminal activities, legal violations; conduct certain investigative activities as prescribed by criminal procedure law regarding very serious and particularly serious crimes according to criminal law;- Have the capability to provide professional guidance to Junior Police Officers.

In cases where a person meets the criteria specified in Article 7 of this Circular and points b, c of Clause 1 Article 9, and has been working in legal affairs for 07 (seven) years or more, based on the personnel needs of the marine police agencies or units, they can be appointed as Intermediate Police Officers.

Additionally, Circular 177/2019/TT-BQP also stipulates that Police Officers and Investigative Officers can be appointed in special cases when the following conditions are met:

- In special cases, officers who are transferred to work at marine police agencies or units, not meeting the conditions specified in point a of Clause 1 Article 9, point a of Clause 1 Article 10 of this Circular, but meeting the standards specified in Clauses 1, 2, 4 Article 7; Clause 2 Article 8; points b, c of Clause 1 Article 9; points b, c, d of Clause 1 Article 10, can be appointed as Intermediate Police Officers or Senior Police Officers.- In special cases, officers who are transferred to work at marine police agencies or units, not meeting the conditions specified in point a of Clause 1 Article 12; point a of Clause 1 Article 13 of this Circular, but meeting the standards specified in Clauses 1, 2, 4 Article 7; points b, c of Clause 1 Article 12; points b, c, d of Clause 1 Article 13, can be appointed as Intermediate Investigative Officers or Senior Investigative Officers.
