Three cases in which teachers can resign and receive 100% salary

According to current regulations, teachers are entitled to annual leave in cases such as summer vacation, Lunar New Year holiday, semester break, and other holidays.

The annual leave days for teachers are stipulated in Circular 28/2009/TT-BGDDT, as amended and supplemented by Circular 15/2017/TT-BGDDT. To be specific:

1. Summer Break

Currently, according to Clause 4 Article 1 of Circular 15/2017/TT-BGDDT, the annual summer break for teachers is 02 months (including annual leave as prescribed by the Labor Code), during which they receive full salary and allowances (if any).

2. Lunar New Year Break, Semester Break

According to Point b Clause 3 of Circular 28/2009/TT-BGDDT, the Lunar New Year break is as prescribed by the Minister of Education and Training.

3. Other Leave Days

Other leave days are regulated generally by the 2012 Labor Code, specifically in Clause 1 Article 115:

- New Year’s Day: 01 day (January 01, Gregorian calendar);

- Lunar New Year: 05 days;

- Victory Day: 01 day (April 30, Gregorian calendar);

- International Labor Day: 01 day (May 01, Gregorian calendar);

- National Day: 01 day (September 02, Gregorian calendar);

- Hung Kings' Memorial Day: 01 day (March 10, lunar calendar).

Simultaneously, Clause 1 Article 116 of the 2012 Labor Code stipulates that teachers are also entitled to leave with full pay for personal reasons in the following cases:

- Marriage (3 days);

- Death of biological parent (3 days);

- Death of parent-in-law (3 days);

- Death of spouse (3 days);

- Death of biological child (3 days);

- Marriage of biological child (1 day).

Additionally, according to Clause 3 Article 5 of Circular 15/2017/TT-BGDDT, the arrangement of annual leave for teachers is determined by the principal based on the school year plan, scale, characteristics, and specific conditions of each school.
