In order to assist our esteemed members in easily understanding the regulations on salaries and bonuses during the Lunar New Year 2018, Thu Ky Luat would like to share some points that everyone should pay attention to as follows:
TEMPLATE OF SALARY AND BONUS REGULATIONS FOR 2018
1. Employees are entitled to a five-day Tet holiday with full pay (100%).
Based on Point b Clause 1 Article 115 of the Labor Code 2012
2. If working overtime during Tet, employees are entitled to 400% of their salary for that overtime day.
Based on Point c Clause 1 Article 97 of the Labor Code 2012
Article 97. Overtime pay, night work pay 1. Employees working overtime are paid according to the wage unit price or the wages of current work as follows: ... c) On public holidays, paid leave days, at least 300% not including the wages of public holidays, paid leave days for employees who receive daily wage. |
3. Employees are entitled to 490% of the normal daily salary if they work overtime during the night on Tet holidays.
In addition to the 400% salary enjoyed on Tet holidays as stipulated in Point c Clause 1 Article 97 of the Labor Code 2012, if employees work at night during Tet, they will receive an additional 90% of the normal daily salary.
In total, employees will receive 490% of the normal daily salary for working during the night on Tet holidays.
The above content is based on Clauses 2, 3 Article 97 of the Labor Code 2012.
4. Employees are entitled to a 13th month salary if mentioned in the employment contract or collective labor agreement.
5. Employers are not obligated to provide Tet bonuses to employees.
Based on Clause 1 Article 103 of the Labor Code 2012, Tet bonuses are at the discretion of the employer.
If a bonus is decided, the amount depends on the annual business performance and the level of job completion by the employees.
