This is an important content stipulated in the Draft Law Amending and Supplementing the Law on Cadres and Civil Servants and the Law on Public Employees, expected to take effect on January 01, 2020.

To be specific, according to Clause 2, Article 2 of this Draft amending Article 25 of the 2010 Law on Public Employees regarding the types of working contracts of public employees, from the effective date of the amended Law on Cadres, Officials, and the Law on Public Employees, all cases without indefinite-term employment contracts must sign fixed-term contracts.
A fixed-term working contract is a contract in which the two parties determine the duration and the termination time of the contract within a period ranging from 12 months to 36 months.
An indefinite-term working contract is a contract in which the two parties do not determine the duration and the termination time of the contract.
According to the amendments in this Draft, from January 1, 2020, there will only be three cases where indefinite-term working contracts are allowed, including:
- Public employees who have signed fixed-term working contracts before the effective date of the amended Law on Cadres, Officials, and the Law on Public Employees;- Cadres, officials transitioning to public employees;- Public employees who have completed fixed-term contracts at public service providers in remote areas, regions with exceptionally difficult socio-economic conditions.
Thus, from the effective date of the amended Law on Cadres, Officials, and the Law on Public Employees, there will no longer be cases where public employees, after completing a fixed-term contract, automatically transition to an indefinite-term contract as currently practiced. In other words, the policy of lifelong public employees will no longer exist.
